المستخلص: العلاقة بين العلم وما يفرزه من تقدم تقني إلكتروني وبين القانون وقواعده المنظمة للمجتمع علاقة قوية وراسخة، قامت قدرا من الترابط والتعاون الوثيق بينهما. فكلاهما يؤثر في الآخر ويتأثر به، وظهر لنا نتيجة هذا الترابط بين العلم والقانون ما يمكن تسميته بالقانون العلمي أو قانون العلم، الذي يهتم بمتابعة التطورات العلمية الحديثة، ويستجيب لمتطلباتها وما تحتاجه من أنظمة قانونية وتنظيمية. والتقدم العلمي والتقني ضرورة ملحة في عصرنا الحالي لتقديم الحلول التي يحتاجها القانون لتنظيم المجتمع وما ينشأ داخله من علاقات قانونية واجتماعية واقتصادية لتحقيق التقدم والرفاه لأفراده. ومن أبرز ما قدمه التقدم العلمي والتقني في عصرنا الحالي في نطاق القانون بصفة عامة ونظرية العقد بصفة خاصة، هو استخدام الطرق والوسائل التكنولوجية المتقدمة لإبرام العقود والتصرفات القانونية وإثباتها فأوجد بذلك، إلى جانب العقود في صورتها التقليدية المعتادة، العقود الإلكترونية التي تقوم إلى حد ما على أتمته وتلقائية إبرامها وتوثيقها وإثباتها. ولم يقف التقدم التقني عند ذلك، وإنما أفرز لنا، مع بداية القرن الحالي مزيدا من الآلية والأتمتة في إبرام العقود والتصرفات القانونية وإثباتها وتنفيذها باستخدام الذكاء الاصطناعي الذي يقوم على إكساب الأجهزة والآلات الصماء الذكاء البشري، ومن ثم إمكان قيامها بإبرام العقود والتصرفات والأعمال القانونية المختلفة، وذلك من خلال ما يسمى بالعقد الذكي Smart Contract. وينصب هذا البحث على بيان دور التقدم التقني والذكاء الاصطناعي في تطوير القواعد القانونية المنظمة لإبرام العقود والتصرفات القانونية من خلال موضوعات ثلاثة، هي: -مفهوم الذكاء الاصطناعي، وظهوره وتطوره وتطبيقاته القانونية. -التقدم التقني وأتمته العقود والتصرفات القانونية. -العقد الذكي واستخداماته القانونية.

The relationship between science and its electronic technical progress and the law and its rules governing society have developed a strong and well- established relationship, which has established a degree of close interdependence and cooperation between them. Both affect each other and are influenced by it, and as a result of this interconnection between science and law has shown us what might be called the scientific law or the law of science, which is concerned with the follow-up of modern scientific developments, and responds to its requirements and the legal and regulatory regulations it needs. Scientific and technical progress is an urgent necessity in our time to provide the solutions that the law needs to regulate society and the legal, social and economic relationships within it to achieve the progress and well-being of its members. One of the most notable scientific and technical advances of our time in the scope of law in general and the theory of contracts in particular is the use of advanced methods and technological means to conclude and prove contracts and legal procedures, thus creating, in addition to contracts in their usual traditional form, electronic contracts based to some extent on its mandate and automatic conclusion, documentation and proof. Technical progress did not stop at this, but at the beginning of the current century produced us more mechanism and automation in the conclusion of contracts and legal procedures and prove and implementation using artificial intelligence, which is based on the creation of devices and endocrine machines human intelligence, and thus the possibility of concluding contracts, actions and various legal actions, through the so-called Smart Contract. This research focuses on demonstrating the role of technical progress and artificial intelligence in the development of the legal rules governing the conclusion of contracts and legal procedures through three topics, each of which we make a special research as follows: The first topic: the concept of artificial intelligence, its appearance, development and legal applications. The second topic: technical progress and the automation of contracts and legal acts. The third topic: smart contract and its legal uses.
