بين الله جل وعلا بما شرعه من الطرق أن مقصودة إقامة الحق والعدل وقيام الناس بالقسط، فأي طريق استخرج بها الحق ومعرفة العدل وجب الحكم بموجبها ومقتضاها، ومن هذه الطرق التي شرعها الله جل وعلا لإعطاء كل ذي حق حقه، ووضع كل شيء موضعه، ووفاء كل ذي قسط قسطه الشهادة، فالشهادة من أعظم التوثيقات التي بها تحفظ الحقوق، وأرفع البينات التي بها تفض المنازعات؛ لذا عظم الشارع شأنها، ورغب فيها، وشرعها، وقدسها، وأمر بتحملها، ونهى عن كتمانها. ومن هنا كانت أهمية البحث الذي نحن بصدده، حيث تناول جزئية مهمة من جزئيات الشهادات، تتعلق بشرط من شروط صحتها، وهي إسلام الشاهد في الفقه الإسلامي والقانون الكويتي. فتناول الباحث في هذا البحث تعريف الشهادة لغة وفي اصطلاح الفقهاء والقانونيين والمقارنة بينهما، ثم تطرق إلى مشروعية الشهادة في الفقه الإسلامي والقانون الكويتي والمقارنة بينهما، ثم تناول حكم تحمل الشهادة وأدائها في الفقه الإسلامي والقانون الكويتي والمقارنة بينهما، وحكم اشتراط إسلام الشاهد حال تحمل الشهادة وأدائها في الفقه الإسلامي والقانون الكويتي والمقارنة بينهما، ثم ختم البحث بذكر أهم النتائج التي توصل إليها الباحث.
Allah intended to show what he ordained from his ways that his intention is to establish the truth and justice and establish the fairness among people. So, in any way the right and justice would be extracted, it must be judged and required to work by it. One of these methods that were ordained by Allah to give everyone his right, put everything in its place, and have faithfulness to give everyone his right of testimony. The testimony is one of the greatest documentations that preserve the rights, and raise the proofs that dissolve the disputes. Therefore, Allah honors its importance, aspires to it, ordains it, sanctifies it, orders to bear it, and forbids to withholds it. Hence, this is the importance of the research with which we are dealing. So, it deals with an important part of the testimonies which are relating to a condition of its validity. Therefore, the title of this research is (Testimony of Non-Muslims in Primary Study Compared of the Kuwaiti Law). So, this research will include Testimony definition and relevant terms, legality of witness, Non-Muslims sections, obligation sentence for bearing testimony and its performance, Islam is required to bear the testimony case and the case of testimony performance, Islam is required of the witness in Kuwaiti law, and then the conclusion will be the most important results that founds by researcher.
