|a تعتبر مهنة المحاماة مهنة جليلة لها قدسيتها ورسالتها السامية، وهي مهنة حرة تشارك السلطة القضائية في تحقيق العدالة، ونظراً للدور المهم التي تلعبه المهنة فإن القانون المنظم لمهنة المحاماة بحاجة إلى التحديث في كثير من جوانبه فعلى الرغم من تضمنه العديد من الجوانب الإيجابية، إلا أنه لازال يحتوي على مجموعة من المقتضيات التي لم تصادف الصواب أو تحتوي على تناقضات بالإضافة إلى العديد من الاغفالات التي تم نسخها في مشروع القانون المنظم لمهنة المحاماة، وقد حاولت تسليط الضوء عليها محاولة إبراز جوانبه السلبية وسبل تجاوزها من خلال قراءة في مقتضياته التي تثير إشكالا، فالحاجة أصبحت تلح لزوما على إصدار تشريع يواكب بصفة عامة كل المتغيرات التي يشهدها العالم بالشكل الذي يجعله قادرا على حماية المهنة، وذلك بإعطائها ما هو جدير من حماية وعناية لائقة حتى تؤدي رسالتها النبيلة خدمة للحق وسيادة للقانون.

|d La profession d'avocat est un métier libérale et indépendante ainsi qu'elle fait partie de la famille judiciaire comme partenaire pour aider à obtenir la justice. Vu l'importance cruciale que joue le rôle de la profession d'avocat, il serait nécessaire de mettre à jour plusieurs aspects de la loi qui la réglemente. En dépit de ses dispositions positives, elle connu plusieurs d'autre dispositions mise en question et paradoxale, s'y ajoute, de nombreux omissions des dispositions du projet de loi qui organise la profession d'avocat. En effet, j'ai essayé de les mettre en lumière en mettant en exergue ses aspect négatif ainsi de proposer des solutions à partir d'une lecture minutieuse de ses dispositions qui créent des problématiques, d'où la nécessité de solliciter l'intervention de législation pour élaborer une loi capable de suivre le rythme des changements mondiaux d'une manière fluide et limpide pour qu'elle atteint son objectif principal qui est de protéger la profession.

|f The legal profession is considered to be a solemn profession with its sanctity and lofty mission. It is a free profession that participates with the judiciary in the pursuit of justice. Given the important role played by profession, the law governing it needs to be updated in many aspects. Although it includes many positive aspects, it still contains a set of requirements that are not correct or contain contradictions in addition to many omissions that are reproduced in the draft law regulating the legal profession. I have tried to highlight it in an attempt to highlight its negative aspects and ways to overcome them through a reading of its problematic exigencies. There is a need to enact legislation that generally keeps pace with all the changes that the world is witnessing in such a way as to enable it to protect the profession by giving it the right protection and proper care so that its noble mission can serve the right and the rule of law.
