المستخلص: تواجه أجهزة البحث والتحقيق في الجرائم الإلكترونية جملة من التحديات أثناء القيام بالبحث والتقصي وتفتيش وضبط الجرمية الإلكترونية وذلك راجع لمجموعة من الصعوبات التي تعترض هذه الأجهزة وتحول دون الوصول إلى مرتكبي بعض هذه الجرائم وبالتالي الحيلولة دون تحقيق العدالة المرجوة من المجتمع وذلك لعدة أسباب منها ما يتعلق بطبيعة الدليل الإلكتروني نفسه كالطبيعة غير المرئية لهذا الدليل مما لا يمكن ضحايا هذه الجرائم من اكتشافها والتبليغ عنها، وإعاقة الوصول له من خلال وضع الجناة لمجموعة من العقبات الفنية كالتشفير مثلاً فضلاً عن سهولة تدمير وإخفاء الدليل، ومنها ما يرجع للتحديات المرتبطة بالعامل البشري كنقص كفاءة القائمين بالتحقيق إذ يقعون في كثير من الأحيان في أخطاء من شأنها أن تؤدي إلى محو الأدلة الإلكترونية أو تدميرها خاصة أمام ضخامة البيانات التي يحتويها الدليل، بالإضافة إلى قلة التعاون والتنسيق بين الدول للتصدي لهذا النوع من الإجرام.

Fruit de la révolution numérique, la cybercriminalité se développe à grande échelle dans cet univers favorable, au point de viser aujourd’hui l’ensemble des infrastructures économiques, politique et sociales. Comme toute forme de délinquance, la cybercriminalité impose des réponses préventives mais aussi répressives, sans pour autant que celles-ci ne foulent les valeurs fondamentales incarnées au sein de la matière pénale. La cybercriminalité est un phénomène qui ne cesse de prendre de l’ampleur dans le monde et aussi au Maroc. Malheureusement, la lutte contre ce phénomène est loin d’être facile. Plusieurs obstacles techniques et surtout juridiques se dressent devant les efforts menés pour lutter et prouver cette forme de criminalité. Le caractère vaste des réseaux informatiques ainsi que la rapidité dans la commission des infractions figurent parmi les principaux obstacles pour prouver cette infraction.

Cybercrime search and investigation agencies face a number of challenges while conducting search, investigation, inspection, and controlling of cybercrime. This is due to a number of difficulties encountered by these agencies that prevent reaching the perpetrators of some of these crimes and thus prevent the achievement of the justice desired by the community. This is due to a number of reasons, including those related to the nature of the e-directory itself, such as the invisible nature of this directory, which victims of these crimes can't detect and report, and some are related to the obstructions in accessing this directory as the perpetrators put a range of technical obstacles such as encryption, as well as easy destruction and concealment of evidence. There are some reasons related to the challenges associated with the human factor, such as the lack of competence of the investigators, as they often commit mistakes that could lead to the erasure or destruction of e-evidence, especially in the face of the magnitude of the data contained in the evidence.
