المستخلص: يهدف هذا المقال إلى تسليط الضوء على الجهود الدولية والجزائرية لحماية الأطفال العاملين من الاستغلال الاقتصادي، وتوضيح الفرق بين "عمالة الأطفال" والحالة الاستثنائية التي يسمح فيها المشرع لهؤلاء بالولوج إلى عالم الشغل، مع الإشارة إلى الإطار القانوني الإقليمي والدولي الذي وضع لدعم جهود الدول في هذا الصدد. وقد اعتمد المشرع في قبول تشغيل الطفل على مرافقة المنظمات الدولية والإقليمية المهتمة بحقوق الطفل المشغل بما تصدره في مواثيقها وتطرحه في اتفاقياتها؛ لتوجيه جهود الدول الوطنية لضمان حقوق الطفل من استغلال مشغليه. ورغم ذلك فالواقع يبين مدى الضعف في ضمان هذه الحقوق؛ لأسباب ذكرت في المقال. والهدف من المقال هو رفع الغموض عن مفهومي "شغل الطفل" و"استغلال الطفل اقتصاديا" ونشر الوعي بخطورة الاستغلال الاقتصادي للأطفال؛ لتوجيه أنظار الأوصياء على الأطفال بمشكلة الاستغلال، وتبيان مدى الضمانات القانونية الموفرة لحماية حقوق الأطفال؛ بالمرافقة الدولية والإقليمية والوطنية لهم. والمنهج المتبع هو: المنهج الوصفي. يستهل هذا البحث بتقديم صورة عن واقع "الطفل العامل" وذلك عبر إبراز أهم الأسباب التي دفعت به إلى الالتحاق بالعمل وكذا تأثيره عليه، ثم ينتقل إلى تقديم المنظمات الإقليمية والدولية العاملة في الميدان، وكذا الآليات المستخدمة من قبل هذه المنظمات لحماية الأطفال العاملين من الاستغلال الاقتصادي. أخيرا تمت الإشارة إلى الجهود الدولية والجزائرية في الميدان مع الإشارة إلى الإطار التشريعي الجزائري والدولي المتعلق بحماية الأطفال العاملين من الاستغلال الاقتصادي.

The present article aims at shedding light at the Algerian as well as the international efforts to protect the working children from economical exploitation, and providing a clear distinction between “child labor “and the exceptional case in which children are legally allowed to join the workforce with a reference to the regional and international framework that was put in place to support the efforts of the national states. Thereby, the reliance on the descriptive method is justified by the need to raise awareness about “child labor “and “economical exploitation “and about the existing ad hoc legislative arsenal that was put in place to protect the working children from any form of economical exploitation. This research begins with depicting the reality of the working child through tackling the reasons that led him to work and it’s impact on his life, then it moves to the presentation of the regional and the international organizations working in the field, and the mechanisms used by these organizations to protect children from economical exploitation, and finally, revealing the international as well as the Algerian efforts in the area with a reference to the national and international ad hoc acts and conventions.

Cet article tente de mettre en lumière les efforts algériens et internationaux qui visent à protéger les enfants travailleurs de l’exploitation économique. Nous essayons de souligner la différence entre “ le travail des enfants “ interdit par la loi et le cas exceptionnel où la loi permet aux enfants d’accéder au marché du travail. Pour faire cette étude, nous nous reposerons sur la méthode descriptive car elle sensibilise les gens sur l’exploitation de l’enfant et les informe sur les mesures législatives mises en place pour faire face à toutes les formes d’exploitation économique des enfants travailleurs. Dans cette recherche, nous commençons par décrire la réalité de l’enfant travailleur à travers les raisons qui le poussent à faire ce choix et aussi les effets de ce dernier sur sa vie. Puis nous étudions les mécanismes utilisés par les organisations régionales et internationales pour protéger les enfants contre l’exploitation économique. Finalement, nous révélons les efforts algériens et aussi internationaux dans le domaine juridique en étudiant les lois algériennes et les conventions internationales en relation avec la protection des enfants dans le monde du travail
