المستخلص: أصبحت ظاهرة الفساد في القضايا الراهنة على الساحة الدولية والمحلية تشكل عائقا أمام الإصلاح والتنمية والاستثمار، وذلك بتأثيره السلبي على الاقتصاد الوطني وفي بحثنا هذا أردنا تسليط الضوء على جريمة تعارض المصالح كأحد أنواع جرائم الفساد لما تشكله من أهمية في إيقاف عجلة التطور والتنمية في البلاد. إن هدف المشرع الليبي هو العقاب على مختلف جرائم الفساد التي تعد مساسا بالمال العام تماشيا في ذلك مع اتفاقية الأمم المتحدة لمكافحة الفساد والتي صادقت عليها ليبيا بموجب قانون رقم 10 سنة 2005 تلك الاتفاقية التي جرمت الكسب غير مشروع والمتاجرة بالنفوذ وإساءة استغلال الوظيفة تلك الجرائم التي تعد نماذج من جرائم تعارض المصالح، لقد سطرت اتفاقية الأمم المتحدة لمكافحة الفساد مبادئ قانونية وقائية غايتها الأساسية الوقوف في وجه هذه الآفة دوليا وإقليما ووطنيا، لقد تناول هذا البحث بالدراسة اتفاقية الأمم المتحدة لمكافحة الفساد مع التركيز على جريمة تعارض المصالح وذلك من خلال دراسة نصوص الاتفاقية وتحليلها وما فرضته على الدول من التزامات.

Corruption has become one of the current international and local issues and forms an obstacle to reform, development and investment due to its negative impact on the national economy. In our research, we wanted to focus on the crime of “conflict of interest” as one of the types of corruption crimes because of the importance it constitutes in stopping the wheel of development in the country. The aim of the Libyan legislator is to punish various corruption crimes that are considered insulting to public money and in line with the United Nations Convention against Corruption, which Libya has ratified under Law No. (10) 2005, that convention that criminalized illegal gain, influence trading and abuse of employment. Those crimes that are considered examples of conflicts of interest crimes. The United Nations Convention against Corruption has laid down legal and preventive principles whose main aim is to stand against this blight on the international, regional and national levels. This research has dealt with the study of the United Nations Convention against Corruption with a focus on the crime of conflict of interest, through studying and analyzing the provisions of the agreement and the obligations imposed on states.
