|b To guarantee the mustn’t exceed the military laws of the main legislation in the state. The constitutional censorship has found to boycott the violation of rules and constitutions texts. Indeed, the later represents the base stone which is considered the including of the rights and freedom of people and others of general rules of the system of the government in the state. Moreover, it covered (Constitution) the specific rules of constitutional censorship on the laws and, the latter (constitutional censorship) is represented into kinds, the first kind deals with political control on the constitution of military laws that is applied in Algeria, France and other Arab countries. And there is the judicial control on the constitutional military of laws that works with it in Germany, the U.S.A and others.

|a لضمان عدم تجاوز القوانين العسكرية للتشريع الأساسي في الدولة وجدت الرقابة الدستورية لمنع التعدي على قواعد ونصوص الدستور، حيث يمثل هذا الأخير الركيزة الأساسية باعتباره يشمل الحقوق والحريات المتعلقة بالأفراد وغيرها من القواعد العامة لنظام الحكم في الدولة، بالإضافة إلى أنه يشمل القواعد المحددة للرقابة الدستورية على القوانين، وهذه الأخيرة تتمثل في نوعين النوع الأول يشمل الرقابة السياسية على دستورية القوانين العسكرية والذي يطبق في الجزائر وفرنسا وغيرها من الدول العربية، وهناك الرقابة القضائية على دستورية القوانين العسكرية والتي يعمل بها في ألمانيا والولايات المتحدة الأمريكية وغيرها.
