المستخلص: على ضوء الدارسات المتنوعة للباحثين في الحقل الأنثربولوجيا الجريمة ومدى قانونية وعدم قانونية الفعل الإجرامي، آخذين بعين الاعتبار العوامل الاجتماعية والثقافية المؤثرة في ظاهرة الإجرامية وأساليب مواجهتها وسعي تلك الدارسات إلى ربط سلوك الفاعل للجريمة بالمعايير الأخلاقية، وكذا ربطها بالوجهة القانونية للفعل ذاته، فالجرائم الفرنسية أنموذجا لتلك الدارسات ببعديها التاريخي والقانوني، مهما كانت نوع تلك الجرائم من تعذيب وتنكيل وإبادة والقتل بأنواعه، والتعذيب النفسي والجسدي، والقتل البطيء والقتل الفوري... الخ، وفي هذه الورقة نطرح أنموذجا لمقاربة في الأنثروبولوجيا الجريمة القانونية مثاله من شهادات الجنرال ((بول أوساريس)) في تعذيب وقتل الشهيد البطل العربي بن مهيدي من خلال أبعاد الجريمة من ناحية التاريخية والقانونية والتجريبية والإثنوية والنفسية.

Basant sur les déférentes études des chercheurs dans le domaine de l’anthropologie criminelle en matière de légalité ou d’ illégalité de l’acte criminel mettant en considération des éléments sociaux et culturels qui influencent sur le phénomène criminel et les manières de le traiter a fin de lier le comportement du criminel aux critères morales et juridiques de l’acte lui-même abordant les crimes français comme type de ces études dans leurs démentions historique et juridique peut importe le genre de crime (torture génocide etc. Dans cette approche on expose un type en anthropologie du crime juridique le témoignage du général (Pole ausaress) a la torture et l’assassinat de l héros martyre (larbi ben mhedi).

In the light of the various studies of researchers in the field of crime anthropology and the extent of the legality and illegality of the criminal act, taking into account the social and cultural factors affecting the criminal phenomenon and the methods of confronting it, and the endeavor of these studies to link the behavior of the perpetrator of the crime with moral standards, as well as to link it to the legal destination of the act itself, French crimes are a model for those Studies in their historical and legal dimensions, regardless of the type of those crimes of torture, abuse, extermination, killing of all kinds, psychological and physical torture, slow killing and instant killing...etc. In this paper, we present a model for an approach to legal anthropology crime, an example from the testimonies of General (Paul Aussaresses) in the torture and murder of the heroic martyr Larbi Ben M'hidi through the dimensions of crime in terms of historical, legal, experimental, ethnic and psychological aspects.
