المستخلص: يظهر للعيان بأن المجلس الدستوري هو هيئة سياسية مستقلة، ونحن لا ننكر ذلك، ولكن إذا تفحصنا جيدا طبيعة المهام الرقابية الملقاة على عاتقه، خاصة الرقابة على دستورية القوانين، وكافة الإجراءات التي ترافقه في ذلك، فإننا نلمس فيها الصبغة القضائية نظرا لعديد المؤشرات والملامح التي يمكن استخلاصها من حجم صلاحياته وإجراءات سيرورتها، انطلاقا من عديد المعايير، وعليه يمكن الجزم إلى حد كبير بأن طبيعة الرقابة القضائية التي يمارسها المجلس الدستوري الجزائري وفقا للتعديل الدستوري 2016 هي رقابة ذو طبيعة قضائية.
وهذا ما تم التطرق إليه وتناوله من خلال هذا العمل البحثي، والذي سنغوص من خلاله في سرد أهم الحيثيات القضائية التي تتخلل الصلاحيات والمهام الرقابية للمجلس الدستوري.


It is visible that the Constitutional Council is an independent political body, and we do not deny that. However, if we examine well the nature of the supervisory tasks assigned to it, especially the control over the constitutionality of laws, and all the procedures that accompany it in that regard, we will realize the judicial nature in them given the number of indicators and features that can be derived from the size of its powers and the procedures of its functioning, based on many indicators. It can therefore be largely asserted that the nature of judicial control exercised by the Algerian Constitutional Council in accordance with the 2016 Constitutional Amendment is judicial in nature. This is what has been addressed and discussed through this research work, through which we will dive into listing the most important judicial facts that permeate the powers and supervisory functions of the Constitutional Council.

Apparaît évident que le Conseil constitutionnel est un organe politique indépendant, et nous ne le nie pas, mais si l'on examine la bonne nature des tâches réglementaires qui lui sont confiées, en particulier le contrôle de la constitutionnalité des lois, et toutes les procédures qui l'accompagnent, nous touchons la nature judiciaire en raison des nombreux indicateurs et fonctionnalités il peut être dérivé de la taille de ses pouvoirs et procédures Sirortha, en fonction de plusieurs critères, et on peut affirmer dans une large mesure que la nature du contrôle juridictionnel exercé par le Conseil constitutionnel algérien, conformément à l'amendement constitutionnel en 2016 est le contrôle de nature judiciaire.
C'est ce qui lui a été adressée et traités dans ce travail de recherche, qui Snghos à travers laquelle le plus important raisonnement judiciaire qui imprègne sont énumérés les pouvoirs de contrôle et les fonctions du Conseil constitutionnel.
