|a إن ما يميز حالة الظروف الاستثنائية وفرض حالة الطوارئ أنها لا تخرج عن أحكام الدستور مهما كانت الظروف الطارئة التي تتعرض لها الدول من شدة أي لا بد من أن تكون حالة الطوارئ مستندة إلى قواعد دستورية تنص عليها الدساتير ضمن الحدود التي تمكن السلطة التشريعية من إصدار ما تشاء من قوانين لمواجهة الحالات والظروف الاستثنائية كما إن المبرر الأساسي لفرض حالة الظروف الاستثنائية والطوارئ هو حماية المصلحة العامة للدولة أي حماية النظام العام والأمن العام والدفاع عن تراب وأرض الدولة بهدف حماية مصالح الشعب. وتتمثل أهمية البحث في أنه يحدد البحث الحالات الاستثنائية التي تستدعي فرض حالة الطوارئ، وخاصة عندما تتعرض الدولة لظروف تهدد أمنها وسلامتها كما أنه يحدد البحث الأساس القانوني الذي تستند عليه فرض حالة الطوارئ في الدستور والمواثيق الدولية ذات الصلة، كما أنه يحدد البحث الشروط القانونية لفرض حالة الطوارئ، مع ضرورة ألا تتعارض مع حقوق الإنسان. يمكن بلورة مشكلة البحث في التساؤل التالي: ما هي الحالات التي تستدعي فرض حالة الطوارئ، والشروط القانونية لتطبيقها؟ كما أن أهداف البحث تتمثل في تحديد وحصر الحالات الاستثنائية التي تستدعي فرض حالة الطوارئ والبحث في الشروط القانونية لفرض حالة الطوارئ في القانون الدولي وبعض الدساتير العربية والأجنبية وبيان موقف القانون الدولي من عدم الالتزام بشروط فرض حالة الطوارئ.

|b What distinguishes the state of exceptional circumstances and the imposition of a state of emergency is that it does not depart from the provisions of the Constitution, whatever the emergency circumstances to which States are subjected to the severity of any state of emergency must be based on constitutional rules stipulated by constitutions within the limits that enable the legislature to issue whatever it wishes. The basic justification for imposing the state of exceptional circumstances and emergencies is to protect the public interest of the State, ie the protection of public order and public security, and the defense of the soil and land of the State in order to protect the interests of the people. The importance of the research is that it identifies exceptional cases that require the imposition of a state of emergency, especially when the state is exposed to conditions that threaten its security and safety. Emergency, with the need not to conflict with human rights. The research problem can be crystallized in the following question: What are the cases that require the imposition of a state of emergency, and the legal conditions for its application? The objectives of the research are to identify and limit exceptional cases requiring the imposition of a state of emergency, to examine the legal conditions for the imposition of a state of emergency in international law and some Arab and foreign constitutions and to indicate the position of international law on non-compliance with the conditions of imposing a state of emergency.
