المستخلص: La méthode des règles matérielles est l’une des approches les plus importantes du droit international privé, dans la mesure où les règles juridiques directement applicables aux différends relevant du commerce et de l’économie internationaux sont déterminées. Compte tenu de l'importance de ce sujet dans la législation jordanienne et d'autres lois au niveau mondial, j’ai clarifié l'objectif de ces règles matérilles d'origine locale et internationale, et on amontréqu’il estnécessaire que le juge jordanien applique ces règles si elles sont choisies par les parties ou si ces parties ne se manifestent pas contre ce choix. Ces règles, en particulier celles qui tiennent compte des règles mondiales dans les domaines du commerce et de l’économie, facilitent la mise en oeuvre des décisions étrangères, assurent la sécurité juridique et répondent sans aucun doute aux souhaits des parties, en particulier celles du monde du commerce et des associations professionnelles.

The material rule method is one of the most important approaches to private international law, as long as the legal rules are directly applicable to disputes relating to international trade and economics are determined. Given the importance of this subject in Jordanian legislation and other laws at the global level, We have clarified the objective of these local and international rules, and it has been shown that it is necessary that the Jordanian judge applies these rules if they are chosen by the parties or if these parties do not manifest themselves against this choice. These rules, in particular those which take account of world rules in the fields of trade and economy, facilitate the implementation of foreign decisions, ensure legal certainty and undoubtedly meet the wishes of the parties, in particular those of the world of trade and professional associations.

يعتبر منهاج القواعد الموضوعية أو المادية من أهم مناهج القانون الدولي الخاص، الذي عن يتم عن طريقة حسم المنازعات المتعلقة بالتجارة الدولية بشكل مباشر دون الرجوع إلى قواعد تنازع القوانين. ونظرا لأهمية هذا المنهاج على الصعيد المحلي والدولي فقد قمنا ببيان ماهية تلك القواعد وخصائصها ومصادرها، كما بينا كيفية أعمال تلك القواعد من قبل القاضي الأردني، وفرقنا بين الحالة التي يختار فيها أطراف النزاع لتلك القواعد، وبين الحالة التي يسكت فيها الأطراف عن ذلك الاختيار، وفي هذه الحالة الأخيرة اقترحنا أن يقوم القاضي الأردني بتطبيقها مباشرة على النزاع لما في تطبيق تلك القواعد من تشجيع للتبادل التجاري الدولي وما يحقق تطبيقها من أمان قانوني للأطراف، وما يترتب على تطبيقها من سهولة تنفيذ الأحكام الأجنبية.
