|a جاء هذا البحث لبحث النظرة الشرعية لخدمة التأمين الصحي لشركة عافية والتي فوضتها الحكومة الكويتية في أداء خدمة صحية لمواطنيها، وبيان الحكم الفقهي في هذه المسألة، مع تكييف العمل بها تكييفا فقهيا، كما هدف إلى عرض الرأي القانوني في القانون الكويتي ومقارنته بالرأي الشرعي في الفقه الإسلامي؛ لمعرفة أثر الفقه الإسلامي في القانون الكويتي. هذا وقد جاء البحث في مقدمة وثلاثة مباحث وخاتمة، تم التعريف في المبحث الأول ببرنامج عافية، وفي المبحث الثاني: تم عرض موضوع برنامج عافية، من الناحية الفقهية والقانونية، وبينت فيه آراء العلماء في التأمين الصحي الذي هو موضوع برنامج عافية، والذي يعد أحد أشكال التأمين التعاوني، ثم تناولت العلاقة بين المتقاعد والدولة من خلال بطاقة عافية وقانونه في المبحث الثالث، وعرضت فيه ماهية هذه العلاقة، والمحظورات المترتبة على تلك العلاقة. ثم ختمت تلك المباحث بخاتمة بينت أهم النتائج والتوصيات التي توصلت إليها من خلال بحثي لبطاقة عافية وموضوعها، وأهمها أن برنامج عافية يعد هبة من الدولة للمواطن المتقاعد، ومن ثم فهو حق انتفاع لا حق منفعة، وأن العلاقة بين المتقاعد والدولة علاقة تكاملية إلزامية، وأن برنامج عافية وقانون التأمين الصحي على المواطنين المتقاعدين قائمان على أسس وأحكام شرعية، لا مخالفة فيها لنص شرعي.

|b This research came to discuss the Sharia view of the health insurance service provided by Afia (wellness) company, which was authorized by the Kuwaiti government to perform a health service for its citizens, and aims to explain the jurisprudential judgment in this matter, while adapting its work jurisprudentially, as well as to present the legal opinion in Kuwaiti law and compare it to the Sharia opinion in Islamic jurisprudence to know the impact of Islamic jurisprudence in Kuwaiti law. The research came with an introduction and three investigation and a conclusion, in the first investigation Afia program has been defined, and in the second investigation: presented Afia program (health insurance on retirees), from jurisprudence and legal point of view and outlined the opinions of Islamic scholars on health insurance, which is the subject of Afia Program, which is one of the forms of cooperative insurance, and then dealt with the relationship between the retiree and the state through Afia Health insurance card and its law in the third investigation, also which presented what this relationship is, and the prohibitions in that relationship, Then concluded that investigations with a conclusion showed the most important results i reached through my research of Afia card and its subject - health insurance on retirees - which was the most important that the program of Afia is a donation from the state to the retired citizen, and therefore it is right of use not right of benefit and that the relationship between the retiree and the state is a mandatory integrative relationship, and Afia program and the health insurance law for retired citizens are based on Sharia principles and provisions, in which there is no violation of a sharia text or a jurisprudential opinion.
