|a حظيت مسؤولية الناقل البحري في ظل النظم القانونية الوضعية باهتمام كبير، بل إن تقنين هذه المسؤولية ووضع قواعد محددة لها كان هو الهدف الذي ينادي المجتمع الدولي لإقراره من خلال المعاهدات الدولية المختصة والواقع أن هذا الاهتمام كان له ما يبرره بالنظر للواقع العملي في النقل البحري أنذاك حيث كان الناقلون يرفضون أي فكرة لتحميلهم المسؤولية بمقتضى هذا العقد فيشترطون على الشاحنين أو الركاب إعفائهم منها مستغلين احتكارهم لهذا النوع من النقل مما الحق أضرارا كبيرة بالمتعاقدين معهم وأطراف أخرى كثيرة .
