الحمد لله والصلاة والسلام على رسول الله وعلى آله وصحبة وسلم تسليما كثيرا. وبعد: يناقش موضوع البحث "حظر التجول وتطبيقاته الفقهية من منظور الفقه الإسلامي" قضية من أهم القضايا المستحدثة والنوازل المستجدة لتعلقه بمعاش الناس تحركاتهم اليومية، ويلجأ إليه رئيس الدولة كلما وجد سببه، سواء أكان أمني أم سياسي أم صحي، سواء أكان على المستوى المحلي كالثورات والمظاهرات، أم على المستوى العالمي كالحروب والأوبئة، والهدف من حظر التجول التغلب على تلك الأسباب وإيجاد الحلول لها. وقد تناولت في هذا البحث بيان المصطلحات ذات الصلة بحظر التجول كالإقامة الجبرية، وإعلان حالة الطوارئ، والمنع من السفر، وبينت مبدأ حرية التنقل والتجول وأهدافه. وتناولت في دراسة هذا البحث أنواع حظر التجول وأسبابه، وقرار حظر التجول وموقف السياسة الشرعية منه؛ من حيث تحقيق المصالح الضرورية، وتحقيق الوقاية من الأوبئة والأمراض المعدية، وحماية الأمن والنظام العام. وتناولت بالدراسة والترجيح أحكام حظر التجول وتطبيقاته وأثاره في الفقه الإسلامي فيما يتعلق بالعبادات كأثر حظر التجول على رفع الأذان في المساجد والجمع بين الصلوات، وأثره على صلاة الجمعة والجماعة والعدين، وأثره على ثبوت هلال شهر رمضان، والاعتكاف في المساجد، وأثره على الحج. وتناولت بالدراسة والترجيح أحكام حظر التجول وتطبيقاته وأثاره في الفقه الإسلامي فيما يتعلق بفقه الأسرة من حيث الولاية على عقد الزواج، والمبيت والعدل بين الزوجات والإحداد على الزوج المتوفي. وتناولت بالدراسة والترجيح أحكام حظر التجول وتطبيقاته، وأثاره في الفقه الإسلامي فيما يتعلق بالشهادة وتوبة المحارب وقت الحظر، ثم بينت حكم من خالف قرار حظر التجول، ثم بينت في الخاتمة أهم ما توصلت إليه من نتائج وتوصيات.
