|a إن الصحفيين لم يستثنوا من مجال تطبيق أحكام قانون العمل بل أخضعتهم المادة 4 من القانون رقم 90-11 المتعلق بعلاقات العمل إلى نص تنظيمي خاص، الذي لم يصدر إلى إلا بعد مرور 18 سنة، وأن هذه الفئة من العمال كانت تخضع قبل صدور المرسوم التنفيذي رقم 08/140 المحدد للنظام النوعي لعلاقات العمل المتعلقة بالصحفيين إلى الأحكام الواردة في القانون رقم 90/07 المتضمن قانون الإعلام، إلى جانب الأحكام العامة الواردة في القانون رقم 90/11، بعد صدور القانون العضوي رقم 12/05 الذي ألغى أحكام القانون رقم 90/07 المتعلق بإعلام لأصبحت هذه الفئة من العمال تخضع حاليا للقانون العضوي رقم 12/05 المؤرخ في 12 يناير 2012 المتضمن قانون الإعلام وعلى المرسوم التنفيذي رقم 08/140 المؤرخ في 10 مايو 2008 المحدد النظام النوعي لعلاقات العمل المتعلقة بالصحفيين، بالإضافة إلى أحكام القانون رقم 90/11 المتعلق بعلاقات العمل فيما لم يرد فيه نص في المرسوم التنفيذي الخاص بهم.

|b Journalists were not excluded from the scope of the provisions of the Lab our Law. Article 4 of Law No. 90-11 on industrial relations rather ubject them to a special regulatory text, which was published only after 18 years, and that this category of workers was submitted before the promulgation of the executive decree. n° 08./ 140 specifying the specific regime of journalists' working relationships with the provisions contained in law n ° 90/07 containing the law on information, in addition to the general provisions contained in law n° 90-11 . After the promulgation of Organic Law No. 12/05 repealing the provisions of Law No. 90/07 relating to the media, this group of workers is now subject to Organic Law No. 12/05 of January 12, 2012 on the law on media and Executive Decree 08/140 of May 10. 2008, which specified the specific regime of lab our relations for journalists, in addition to the provisions of Law No. 90/ 11 on lab our relations, as long as there is no text in their executive decree.
