المستخلص: شرع التفريق القضائي بين الزوجين لغاية وحاجة إنسانية، وهو استثناء على الأصل الذي هو دوام الحياة الزوجية، وسبب ظهور هذا الاستثناء هو حدوث الضرر مما يؤدي إلى نهاية مطاف هذا الكيان الأسري. فالتفريق ينفي الضرر في حقوق المتضرر من كلا الزوجين، ويضع القواعد والأحكام الضابطة للأسرة حتى لا يبغي أحد طرفيها على الآخر ولا يُظلم الطرف الأضعف فيها، وينتفي بذلك الضرر ويزال ليذهب كل واحد من الزوجين بطريقه وحياته الخاصة به، ويكون بذلك نهاية الحياة الزوجية، ويسعى هذا البحث إلى بيان مفهوم التفريق القضائي بسبب الشقاق والضرر بين الزوجين، وعرض آراء الفقهاء في هذا النوع من التفريق مع بيان أدلتهم، كما يسلط الضوء على ما ذهب إليه قانون الأحوال الشخصية السوري وشرح مواده المتعلقة بهذا البحث، وعرض اجتهادات محكمة النقض السورية حول ذلك، مع ذكر بعض المقترحات والنتائج التي توصلت إليها من خلال هذا البحث.

Judicial separation of spouses was legislated for a purpose and for a human need, and it is an exception of what is common and ought to be permanent regarding the marital life. Moreover, the reason for the emergence of this exception is the grievance (damage) which leads to the end of the familial life as a social entity. The separation puts an end to the grievance and violation of the rights of the wronged whether it is the wife or the husband. It also sets the rules and provisions governing the family so that neither of its parties oppresses the other and that the weaker party is not wronged. Furthermore, separation could mean that the grievance be avoided and removed so that each of the two spouses (husband and wife) goes on his/her own way and leads his/her own life as the marital life comes to an end. This research (study) aims at clarifying and making clear the concept of judicial separation that results from discord and grievance between the spouses. It also presents the opinions/judgments of the jurists regarding this type of separation and brings to light whatever evidence they have in this respect. It also sheds light on what the Syrian Personal Status Law stipulates in this connection and explains its articles, which are of relevance to this study. In addition to all this, this study presents and analyzes the opinions of the Syrian Court of Cassation about this matter. Finally, this study ends up with mentioning some of the proposals and results that I reached throughout the conducting of this research.
