المستخلص: The regime of diplomatic protection is one of the first known mechanisms in the protection of individual rights. It has proved its effectiveness through many international practices recorded in this framework. With the wave of changes in contemporary international law, especially the remarkable development of legal status, this system had to be developed in order to keep pace with developments. This prompted the United Nations International Law Commission to include the topic of diplomatic protection among the topics suitable for codification and progressive development. What is noteworthy is the Commission providing diplomatic protection to stateless persons.

يعتبر نظام الحماية الدبلوماسية من أولى الآليات المعروفة في مجال حماية حقوق الأفراد وقد أثبت نجاعته عبر الممارسات الدولية الكثيرة المسجلة في هذا الإطار، ومع موجة التغييرات التي شهدها القانون الدولي المعاصر خاصة التطور الملحوظ في المركز القانوني كان لابد من تطوير هذا النظام ليساير التطورات الحاصلة وهذا ما دفع بلجنة القانون الدولي التابعة للأمم المتحدة لإدراج موضوع الحماية الدبلوماسية ضمن المواضيع المناسبة للتدوين والتطوير التدريجي، والأمر الجدير بالاهتمام الذي جاءت به اللجنة هو توفير الحماية الدبلوماسية لعديمي الجنسية.

Le système de la protection diplomatique est l’un des premiers mécanismes connus dans le domaine de la protection des droits des individus a prouvé son efficacité à travers les nombreuses pratiques internationales enregistrées dans ce contexte, et avec les changements intervenus dans le droit international contemporain, en particulier l'évolution notable de la situation juridique était indispensable de développer ce système pour tenir compte de l'évolution il était nécessaire donc de développer le système pour suivre l'évolution, cela a conduit la Commission du droit international des Nations Unies à inclure le sujet de la protection diplomatique parmi les sujets appropriés pour la codification et le développement progressif, et il convient de l'attention portée par la Commission est de fournir la protection diplomatique des apatrides.
