المستخلص: The protection of the environment and the need to preserve it has become one of the topics that have received the interest of jurisprudence with its various branches, especially international law scholars. Maintaining a clean and healthy environment is also one of the most important tasks and responsibilities of the modern state, especially since the human right to live in a healthy environment has become one of the fundamental human rights. It is stipulated in international covenants and laws of various countries.

أصبح موضوع حماية البيئة وضرورة الحفاظ عليها من الموضوعات التي نالت اهتمامات فقه القانون بمختلف فروعه خاصة فقهاء القانون الدولي، كما تعد مسألة الحفاظ على بيئة نظيفة وصحية من أهم مهام ومسؤوليات الدولة الحديثة لاسيما بعدما أصبح حق الإنسان في العيش في بيئة سليمة من الحقوق الأساسية للإنسان، حيث تم النص عليه في المواثيق الدولية وقوانين مختلف الدول.

Devenue primordiale, la protection de l’environnement est une nécessité à préserver. De même, avec les spécialistes du droit internationales, elle a acquit de divers attributs en jurisprudence. Les responsabilités et les taches les plus importantes d’un Etat moderne est le maintient d’un environnement sain et propre. Il est advenu et prescrit dans les lois et les conventions qu’il est fondamental à l’etre humain de vivre dans un environnement propre et sain.
