The Secretary-General of the Municipality occupies an important place at the municipal level, given the importance that this regional group has in the Algerian administrative organization, on the one hand, and the burden of tasks assigned to it in practice, on the other hand. Suppose the Algerian legislator has omitted to mention him absolutely in the laws of the abolished municipality; he has devoted him explicit attention lately. Municipal Law No. 11/10 considered him a main stimulant of the municipal administration. He also received an independent organization under the issuance of Executive Decree No. 16/320 containing the special provisions applicable to him. His powers covered many areas, especially related to municipal decisions, municipal budget, municipal committees, etc. The subject of this study seeks to address the following problem: How effective is the Secretary-General of the Municipality in performing the tasks assigned to him in Algerian legislation? To what extent, according to the Algerian legislature, is the legal coverage of the status of the Secretary-General of the Municipality? This abstract translated by Dar AlMandumah Inc. 2021 يحتل الأمين العام للبلدية مكانة هامة على مستوى البلدية، بالنظر إلى الأهمية التي تحظى بها هذه الجماعة الإقليمية في التنظيم الإداري الجزائري من جهة، وعبء المهام الملقاة على عاتقه في الواقع العملي من جهة أخرى، وإذا كان المشرع الجزائري قد أغفل الإشارة إليه بشكل مطلق في قوانين البلدية الملغاة، فقد خصه باهتمام واضح في الآونة الأخيرة، حيث اعتبره قانون البلدية رقم 11/10 منشطا رئيسا للإدارة البلدية. كما حظي بتنظيم مستقل بصدور المرسوم التنفيذي رقم 16/320 المتضمن الأحكام الخاصة المطبقة عليه، فشملت صلاحياته الكثير من المجالات لاسيما المتعلقة بالقرارات البلدية، الميزانية البلدية، اللجان البلدية،... إلخ. ويأتي موضوع هذه الدراسة لمعالجة الإشكالية الآتية: ما مدى فعالية الأمين العام للبلدية في أداء المهام المسندة إليه في التشريع الجزائري؟ وإلى أي حد وفق المشرع الجزائري في التغطية القانونية لمركز الأمين العام للبلدية؟. Le secrétaire général de la commune occupe une place importante au niveau de la commune, compte en vue de l'importance de la collectivité territoriale dans l'organisation administrative Algérienne d'une part, et du poids des missions qui lui sont confiées dans la pratique d'autre part. Et si la législateur Algérienne a été omis de lui mentionner en terme absolue dans les lois de la commune abrogées, il lui a récemment distingué avec intérêt évident, où la loi de commune n°11/10 lui a considéré comme un promoteur principal de l'administration communal. Comme il y'avait aussi une organisation indépendant avec la publication du décret exécutif n° 16/320 portant dispositions particulières applicables sur lui. Et par conséquent ses pouvoirs comprenaient de nombreux domaines, en particulier ceux qui concernant les arrêté communaux, budget de la commune, Les commissions communal,... etc. Le sujet de cette étude est vient pour traiter le problème suivant : Quelle est l'amplitude de l'efficacité du secrétaire général de la commune dans l'exécution des missions qui lui sont confiées dans la législation Algérienne? Et a quelle limite législateur Algérienne a réussi dans la couverture juridique du statut du secrétaire général de la commune? |
