المستخلص: برزت عناية المشرع الجزائري بالصفقات العمومية من خلال فرض حماية نوعية تعتبر الأكثر فاعلية من سائر أنواع الرقابة الموجودة، ألا وهي الحماية الجزائية لقواعد تنظيمها، وكان ذلك في إطار القانون رقم 01/ 06 الخاص بالوقاية من الفساد ومكافحته، حيث جمع المشرع من خلال هذا القانون الامتيازات غير المبررة التي تستجوب المتابعة الجزائية لصاحبها، وتعتبر جنحة منح الغير امتيازات غير مبررة أو ما يعرف بجنحة المحاباة واحدة من الجرائم التي نص عليها هذا القانون بغية إيجاد حماية حقيقية لمبادئ الشفافية والنزاهة والمنافسة الشريفة التي تقوم عليها عملية إبرام الصفقات العمومية، لاسيما وأن هذه الأخيرة تعتبر مجالا خصبا لتفشي ظاهرة التلاعب بالمال العام التي تلحق أضرار جسيمة وخسائر كبيرة بالاقتصاد الوطني.

The Algerian legislature has attentively cared about public transactions by imposing a thorough protection that is considered the most effective of all existing types of control; namely, the penal protection of the rules organizing public transactions under the law No. 01/06 related to preventing and combating corruption, where the legislature has stated, through this law, unjustified privileges which, in return, require criminal follow-up to its owner. Thus, the misdemeanor of granting unjustified privileges, known as a misdemeanor nepotism, one of the crimes that are stipulated in this law in order to find a real protection of the principles of transparency, integrity and honest competition upon which the public process of procurement of privileges relies, especially since the latter is considered as a fertile ground for widespread of manipulating the public fund which causes extensive damage and significant loss to the national economy.

La réglementation des marches publique prévoit un contrôle efficace des marches qui se traduit par une protection pénale dans le cadre du la loi n06/01 relative a la lutte contre la corruption. Le législateur par le biais de cette loi a instauré le délit d’octroi davantage injustifié, la création de cette infraction répond a la nécessité pour législateur de consolider les règles de transparence de probité et de concurrence loyale concernant les marches publiques, qui constituent souvent un terrain de prolifération de pratique prohibées portant atteintes aux deniers publics et a l’économie nationale.
