المستخلص: The crime of terrorism is one of the crimes that have taken dimensions other than the previous ones by targeting defenseless persons, through intimidation sometimes and individual and collective physical liquidations at other times. Now, the phenomenon of terrorism embodies another meaning in targeting security, economy, and other areas of countries.
It was incumbent upon the international community to create a body tasked with protecting persons as a result of terrorist attacks and punishing the perpetrators of such crimes threatening humanity. However, despite the emergence of this body, i.e., the International Criminal Court, which aims to punish the perpetrators of the most serious crimes against humanity, it has not been included in its jurisdiction to deal with crimes of international terrorism as the will of the forces in control of decision-making within the international community wanted to do so.

باعتبار أن جريمة الإرهاب من بين الجرائم التي أخذت أبعاد غير التي كانت عليها سابقا باستهداف الأشخاص العزل، بالترويع والتخويف أحيانا وبالتصفيات الجسدية الفردية والجماعية أحيانا أخرى أما الآن أصبحت ظاهرة الإرهاب تجسد معنى آخر في استهداف الدول في أمنها واقتصادها وغيرها من المجالات.
وكان لزاما على المجتمع الدولي إيجاد جهاز توكل له حماية الأشخاص من جراء الاعتداءات الإرهابية ومعاقبة مرتكبي هذه الجرائم المهددة للإنسانية، إلا أنه رغم ظهور هذا الجهاز وهو المحكمة الجنائية الدولية التي تهدف إلى إنزال العقاب على مرتكبي الأكثر جرائم الماسة بالإنسانية إلا أنها لم يدرج ضمن اختصاصها النظر في جرائم الإرهاب الدولي كون إرادة القوى المتحكمة في صنع القرار داخل المجتمع الدولي أرادت ذلك.


Considérant que le crime de terrorisme international a pris des dimensions autres que celle qui prévalait dans le passé en ciblant des personnes non armées, parfois d'intimidation, parfois en liquidation physique et collective, le phénomène du terrorisme est devenu un autre moyen de cibler des pays en matière de sécurité, d'économie et d'autres domaines. La communauté internationale doit mettre en place un mécanisme pour protéger la population contre les attaques terroristes et punir les auteurs de ces crimes contre l'humanité. Cependant, malgré la création de la Cour pénale internationale, qui vise à punir les auteurs des crimes les plus graves contre l'humanité, Crimes de terrorisme international parce que la volonté des pouvoirs en place dans la prise de décisions au sein de la communauté internationale le voulait.
