This study aims to try to clarify the most important obstacles that the Arab Charter on Human Rights of 2004 has been facing since its entry into force in March 2008 and the most important solutions for its implementation. We divided it into two parts. In the first part, we talked about the need to document violations in the Arab world and the need to activate the work of the Permanent Arab Court for Human Rights. In the second part, we explained the need to create the post of High Commissioner for Human Rights in the League of Arab States and involve civil society organizations in drafting the statute of the Arab Charter on Human Rights. We ended this study with a conclusion that included some findings and recommendations. This abstract translated by Dar AlMandumah Inc. 2021 تهدف هذه الدراسة إلى محاولة توضيح أهم العراقيل التي يوجهها الميثاق العربي لحقوق الإنسان لعام 2004 منذ دخوله حيز النفاذ في مارس 2008، وأهم الحلول لتفعيله، وقد قمنا بتقسيمها لجزئيين، في الجزء الأول تحدثنا عن الحاجة إلى توثيق الانتهاكات في الوطن العربي وضرورة تفعيل عمل المحكمة العربية الدائمة لحقوق الإنسان، أما في الجزء الثاني فوضحنا الحاجة لإحداث منصب مفوض سام لحقوق الإنسان في الجامعة العربية وإشراك منظمات المجتمع المدني في وضع النظام الأساسي للمحكمة العربية لحقوق الإنسان، كما ختمنا دراستنا هذه بخاتمة تضمنت بعض النتائج والتوصيات. Cette étude vise à clarifier les obstacles les plus importants auxquels est confrontée la Charte arabe pour les droits de l'homme de 2004 depuis son entrée en vigueur en mars 2008, et les solutions les plus importantes pour l'activer, et nous l’avons divisé en deux parties. Dans la première partie, nous avons discuté de la nécessité de documenter les violations dans le monde arabe et la nécessité d'activer le travail de la Cour arabe permanente pour les droits de l'homme, et dans la deuxième partie, nous avons expliqué la nécessité de créer un poste de Haut Commissaire aux droits de l'homme dans la Ligue arabe et la participation des organisations de la société civile à la création du Statut de la Cour arabe pour les droits de l'homme et en guise de conclusion nous présentons les résultats et recommandations proposés. |
