المستخلص: The Arab Charter on Human Rights of 2004 established the Arab Human Rights Committee (the Charter Committee) to monitor and evaluate the actions and measures taken by States parties to implement the rights contained therein and the extent of progress made towards their enjoyment through the mechanism of conducting the examination of initial and periodic reports received from States parties on measures taken in this regard. The Committee submits an annual report to the Council of the League of Arab States containing its observations and recommendations, as stated in its internal law, providing for the authority to interpret the provisions of the Charter. During its review of State reports, the Committee took the initiative to receive parallel reports from non-State actors. However, the shortcomings of the Committee's competence lie in the absence of a mechanism for complaints from individuals and non-governmental organizations concerning allegations of human rights violations in States that are parties to the Charter.

أنشأ الميثاق العربي لحقوق الإنسان لعام 2004، لجنة حقوق الإنسان العربية (لجنة الميثاق)، لتتولى متابعة وتقييم ما اتخذته الدول الأطراف من إجراءات وتدابير لإعمال الحقوق الواردة فيه ومدى التقدم المحرز للتمتع بها وذلك عن طريق آلية إجراء دراسة التقارير الأولية والدورية الواردة من الدول الأطراف عن التدابير المتخذة في هذا الشأن. تقدم اللجنة تقريرا سنويا لمجلس جامعة الدول العربية متضمنا ملاحظاتها وتوصياتها، كما جاء في قانونها الداخلي، النص على صلاحية تفسير أحكام الميثاق. وخلال مراجعتها لتقارير الدول، بادرت اللجنة باستقبال التقارير الموازية من جهات غير الدول، غير أن أوجه القصور في اختصاص اللجنة تكمن في غياب آلية تقديم الشكاوى من الأفراد والمنظمات غير الحكومية بخصوص الادعاءات حول انتهاكات حقوق الإنسان في الدول الأطراف في الميثاق.

Le Comité arabe des droits de l’Homme, établi par la Charte de 2004, veille à sa mise en oeuvre par les Etats parties. Pour ce faire, il examine à intervalles réguliers les rapports des Etats parties sur la façon dont ils en appliquent les dispositions. Il fournit également au Conseil de la Ligue des États arabes un rapport annuel sur ses travaux .Il est compétent également, comme stipulé dans son règlement intérieur, d'interpréter les dispositions de la Charte. Comme il reçoit des rapports parallèles d'organisations non gouvernementales, compétence non prévue par les textes. Néanmoins, des lacunes de la compétence du Comité résident dans l'absence d'un mécanisme de plainte émanant de particuliers et d'organisations non gouvernementales concernant des allégations de violations des droits de l'Homme dans les Etats parties à la Charte.
