| 520 | |f This study attempts to give a picture of the violence against women in the Algerian family. It is considered a crime that preoccupied Algerian society as a result of its infringement upon the essential rights enjoyed by women, i.e., their right to physical integrity. Its seriousness is embodied in the infringement upon the weakest element of society, i.e., women, which leads to serious harm, both on the private level of women and their families and at the general level of disrupting the security and general stability of society. The crime of violence against women is old in its roots. However, with the recurrence of this phenomenon, it has become a new crime because it does not affect women alone but has become a phenomenon affecting all societies of the world. In view of the prevalence of this phenomenon, the Algerian legislator criminalized this phenomenon and imposed a number of penalties in the new amendment No. 15/19. It also criminalized and punished sexual harassment. \nTherefore, we summarize the fact that the crime of violence against women has become a phenomenon that requires concerted efforts in various fields to combat it in order to prevent it from being committed to protect women and safeguard their rights, which are granted and protected by Islamic law in addition to the protection and rights granted to her by law.\nThis abstract translated by Dar AlMandumah Inc. 2021 | ||
| 520 | |d Cette étude tente de donner une image sur la violence contre les femmes dans la societé algerienne; car elle est considerée comme un crime qui a ocupé la communauté; en raison de soin impact sur les droits des femmes et a leurs droits a l’intégrité physique.Son danger est incarné dans la violation de l’élement le plus faible dans la societé qui est la femme; ce qui conduit a des dommages graves tant au niveau privé des femmes ou de leur famille qu’au niveau général.\nLe crime de la violence contre les femmes est ancien a ses racines; mais avec la répetition de ce phénomene; il est devenu un nouveau crime parcequ ‘il n’affecte pas les femmes seulement mais aussi toutes la societé du monde.\nEt en raison de la propagation de ce phénomene; le droit pénal algerien a criminalisé ce phénomene en imposant une série de sanctions dans le movel amendement n°15/19 ainsi que la pénalité d l’hércelement secuel.\nA partir de loi; nous résumons que le crime de violence contre les femmes est devenu un phénomene qui nécessité l’interdépendence des efforts dans divers domaines afin d protéger les femmes et leurs droits qui ont été accordés et protéges par la loi islamique et les droits conférés par la loi.\n | ||
| 520 | |a تحاول هذه الدراسة إعطاء صورة عن العنف الواقع على المرأة في الأسرة الجزائرية فهي تعتبر جريمة شغلت المجتمع الجزائري نتيجة لمساسها بأسمى الحقوق التي تتمتع بها المرأة وهو حقها في السلامة الجسدية، وخطورتها تتجسد في التعدي على أضعف عنصر في المجتمع وهي المرأة، ما يؤدي لأضرار وخيمة سواء على المستوى الخاص للمرأة أو لأسرتها، وعلى المستوى العام من الإخلال بالأمن والاستقرار العام للمجتمع، فجريمة العنف ضد المرأة قديمة في جذورها إلا أنه مع تكرار هذه الظاهرة أصبحت جريمة مستحدثة لأنها لا تمس بالمرأة وحدها وإنما أصبحت ظاهرة تمس جميع مجتمعات العالم، ونظرا لتفشي هذه الظاهرة جرم المشرع الجزائري هذه الظاهرة وسلط عليها مجموعة من العقوبات في التعديل الجديد رقم 15/ 19، كما أنه جرم التحرش الجنسي وعاقب عليه.\nومنه نلخص أن جريمة العنف ضد المرأة أصبحت ظاهرة تحتاج لتكافل الجهود في شتى الميادين لصدها من أجل منع ارتكابها حماية للمرأة وصيانة لحقوقها التي منحتها وحمتها لها الشريعة الإسلامية، وبالإضافة إلى الحماية والحقوق التي منحها إياها القانون.\n | ||
