المستخلص: وجد القضاء الدولي الجنائي من أجل إصدار أحكام قضائية ضد الأشخاص المتهمين بارتكاب جرائم دولية، نتج عنها الكثير من الانتهاكات للقوانين الدولية، وخاصة القانون الدولي الإنساني (اتفاقيات جنيف الأربع 1949، البروتوكولين الإضافيين 1977) وتطبيق هذه الأحكام القضائية الدولية الجنائية يتحكم فيها عدة عوامل، منها العرف الدولي، الذي يعتبر له تأثير إيجابي وسلبي على تطبيق الأحكام القضائية الدولية الجنائية، وتطبيق القانون الدولي الإنساني، ذلك نتيجة لعدم توفر أجهزة دولية تسهر على متابعة تنفيذ هذه الأحكام، وبما أن العرف الدولي عبارة عن عادات تعارفت عليها الدول من قبل، فإن ذلك يعتبر إشكال لأن الزمن في تطور وما اتفقت الدول قديما على اعتباره عرف دولي، قد يكون اليوم يشكل تهديدا أو خطرا على مصالحها مثل حماية اللاجئين موجود قديما والآن الكثير من الدول تعتبرهم أزمة لبلادهم مثل ما اعتبرته مؤخرا فرنسا...

The international criminal justice system has been established to prosecute individuals accused of international crimes, resulting in many violations of international law, particularly international humanitarian law (the Fourth Geneva Conventions, 1949 Additional Protocols 1977). The application of these international criminal judgments is governed by several factors, Including international custom, which has a positive and negative impact on the application of international criminal law and the application of international humanitarian law, as a result of the absence of international bodies to monitor the implementation of these provisions Since international custom is a custom that nations have used before, it is a problem because time is developing and what countries have long accepted as an international custom, which today may pose a threat or a threat to their interests such as refugee protection. They regard them as a crisis for their country, such as France.

La Cour pénale internationale qui se prononce juridiquement sur les crimes internationaux est souvent à l’origine de violations des droits internationaux et surtout des droits humanitaires (les quatre Conventions de Genève de 1949 et Les protocoles supplémentaires au 1977). La juridiction criminelle internationale est contrôlée par plusieurs facteurs : La coutume internationale a un impact positif et négatif sur la demande des dispositions de juridiction criminelle internationale. C'est à cause de l'évolution du temps qu’il est difficile de l’appliquer car ce qui était juste et correct au passé peut être remis en question aujourd’hui comme c’est le cas de la protection des réfugiés qui, à un moment donné, il était un droit, alors qu’il devient actuellement pour beaucoup d'États une crise..
