المستخلص: هذا البحث يحاول تسليط الضوء على موضوع الترجيح بالقواعد الأصولية لدى العلامة خليل من خلال كتابه التوضيح؛ بيانًا لمكانته العلمية وتبحره في مذهب إمامه، وإبرازا لحقيقة الترجيح عنده وكذا أهمية القواعد الأصولية لديه في بيان الراجح من الأقوال والروايات. وذلك وفق منهج استقرائي تحليلي يتم بموجبه تتبع ترجيحات العلامة خليل المبثوثة في كتابه التوضيح، والعمل على تحليلها ربطا لها بمستندها من القواعد الأصولية. لقد بينت الدراسة أن قاعدة الترجيح عند خليل ليست اعتماد أصح الأقوال والروايات وأشهرها كما هو الشأن لدى الكثير من علماء المذهب، وإنما كانت قاعدته الاحتكام إلى الدليل وقوته لا غير؛ يظهر ذلك جليا من خلال ترجيحه للقول الشاذ في مسائل كثيرة، وتضعيف قول إمامه في مسائل أخرى غير يسيرة، وذلك كلما قوي عنده دليل القول الشاذ ودليل القول المخالف لمذهب إمامه. وكانت القواعد الأصولية من أهم ما استند إليه وبنى عليه في ترجيحاته. والملاحظ أنها مست جل المباحث الأصولية، مما يدل على حرص الإمام على اعتبار أصول الفقه عموما وقواعده خصوصا في عملية الترجيح، ويبرز مجالا آخر لها يضاف إلى مجالات استعمالها، كما يبرز ذلك أيضا، تضلع الشيخ ورسوخ قدمه في مذهب إمامه وإحاطته بأصوله وفروعه.

This research attempts to shed light on the subject of weighting of the fundamental rules of the scholar Khalil through his book "Etawdih"; showing his scientific position and his competence in the doctrine of his imam, and a demonstration of the truth of his weighting and the importance of his fundamental rules in the most correct statement of narratives. This paper follows an inductive analytical approach whereby we can follow the weights of the scholar Khalil and link it to the document of fundamental rules; where the study showed that the rule of weighting for Khalil is not the adoption of the most correct sayings and narratives and the most famous ones like the case of many scholars of the doctrine, but it was based on the use of evidence and its validity. This is evident through the weighting of the anomaly sayings in many cases, and the weakening of his imams saying in other cases, and this as the evidence of the anomaly saying and the evidence of the saying of the contrary of the doctrine of his Imam gets more validity. The fundamental rules were the most important things that he relied on and built his weightings from. it is noted that it touched the majority of the fundamental sections, which indicates the keenness of the Imam to consider the principles of jurisprudence in general and its rules, especially in the weighting process, and highlights another area to add to the areas of its use, as also highlights the settlement of the Sheikh in the doctrine of his imam and covering his assets and branches.

Cette recherche tente de faire la lumière sur Les effets de la pondération par les règles fondamentales chez le savant Khalil à travers son livre" Et Tawdhih", montrant sa posture scientifique et son immersion dans la doctrine de son imam, sa conception de la pondération ainsi que l'importance des règles fondamentales dans la relation la plus correcte des récits. L’étude a montré que la règle de pondération chez Khalil ne consiste pas en l’adoption des récits et des propos les plus célèbres comme le font de nombreux érudits de la doctrine, mais des plus avérés. Cela apparait à travers l’adoption de propos anodins dans de nombreuses questions et l'affaiblissement de ceux de son imam dans d'autres, et ce chaque fois que l'argument dans le premier cas parait plus valide que celui de la doctrine de son Imam . Il s'est basé dans ses diverses pondérations sur les règles fondamentales, lesquelles ont touché la majorité des domaines fondamentaux. Cela montre la volonté de Khalil de considérer les principes de la jurisprudence en général et ses règles en particulier, dans le processus de pondération d’un côté et, de l’autre, met en évidence la compétence et l’expérience de Khalil dans la doctrine de son imam par la connaissance de ses origines et ses branches
