المستخلص: جاءت هذه الدراسة بعنوان: أسس استثمار الأصول الوقفية وعوامل تنشيطها في الفقه الإسلامي؛ لتوضح أسس استثمار أموال الوقف، والشروط والضوابط الشرعية لاستثمارها في المجتمع الإسلامي المعاصر. وتنبع أهمية الدراسة من اتجاه الدول المعاصرة نحو الاقتصاد الحر والخصخصة، وتخلي الحكومات -طوعا أو كرها -عن العديد من الأدوار التي استوليت عليها من الأفراد ومن ثم فإن تطوير الوقف وتوسيع أغراضه وتشجيع الأفراد على القيام به يمثل أحد البدائل المهمة المرشحة لسد هذا الفراغ في الدول الإسلامية. فضلا عن تراجع دور الوقف في المجتمعات الإسلامية، بسبب استيلاء بعض الحكومات عليه، وانشغال المسلمين بالحضارة الغربية، وتشريعاتها، ونمط حياتها. ولما كان للوقف أبعاد تاريخية، وحضارية، وفقهية، واقتصادية، وقانونية؛ لذا تطلبت الدراسة استخدام أكثر من منهج مركب ذو أبعاد متعددة، ومن ثم فقد تم الاعتماد على المنهج الوصفي، القائم على الاستقراء، والتحليل، والمقارنة بين بعض الجزيئات، وبعضها. وقد خلصت الدراسة إلى أن المحافظة على أموال الوقف وتنميته ضرورة شرعية، وذلك بهدف استمرارية تقديم المنافع للمستفيدين منه، فضلا عن مجابهة المتغيرات والتحديات القائمة، والتي تظهر مدى الحاجة إلى الوقف في ظل سيادة اقتصاديات السوق الحرة، وتخلي الحكومات -طوعا أو كرها-عن العديد من الأدوار التي كانت منوطة بها. كما أوصت الدراسة بضرورة الإسراع في تحديث المؤسسة الوقفية، وتمكينها من مواكبة التطورات الجديدة؛ بغية إرساء مفاهيم جديدة للعمل الوقفي، بما يتفق مع الأحكام الشرعية، ومتطلبات التنمية بمفهومها المعاصر.

The main objective of this research is to clarify the fundamentals of investing endowment money as well as the legal terms and conditions of investment in the modern Islamic society. The importance of this research stems from the inclination of modern states towards applying free enterprise economy and privatization. In addition, governments give up, voluntarily or unwillingly, a lot or roles, which have been previously played by individuals. Hence, developing, elaborating the purposes of endowment and encouraging the individuals to achieve these missions constitutes one of the likely important alternatives to fill the gap in the Muslim states. Let alone, the decline of endowment in the Muslim communities because some governments have seized it, a large number of Muslims are engaged with the western civilization, its legislations and lifestyle. Due to the historical, civilizational, jurisprudential, economic and legal dimensions of the endowment, this research has applied more than a single approach to cover the various perspectives. Accordingly, the descriptive approach- based upon induction, analysis and comparison in between some details together- has been utilized in this research. The research has found out that protecting the money of endowment and its development is a legal necessity so as to maintain sustainability of benefits for the beneficiaries besides facing the existing challenges and changes which stress the need for endowment with regard to the free market economy and the governments which gave up, voluntarily or unwillingly, a great deal of their entrusted roles. Finally, the research recommends updating the jurisprudential establishment of endowment as soon as possible to help it keep up with the new developments and establish new concepts of endowment work in accordance with the legal provisions and the requirements of development in its modern form.
