المستخلص: إن مقصد الشريعة من التشريع حفظ نظام العالم، وضبط تصرف الناس فيه على وجه يعصم من التفاسد والتهالك، وذلك إنما يكون بتحصيل المصالح، واجتناب المفاسد، على حسب ما يتحقق به معنى المصلحة والمفسدة. كما أن المقاصد الشرعية هي غايات الشارع من الأحكام الشرعية تحقيقا للعبودية، وتقريرا لمصالح العباد في المعاش والمعاد. فمقاصد الشريعة تقوم على جلب المصالح ودرء المفاسد، وأن جميع أحكام الشريعة تقوم على حفظ الضروريات والحاجيات والتحسينات، وعقوبات الحدود هي العقوبات المقدرة من الشارع، ولا مجال للاجتهاد فيها، وتشمل: حد الزنا والقذف وشرب الخمر والردة. وقد تطلبت طبيعة هذا الموضع الاعتماد على المنهج الاستقرائي؛ باستقراء أقوال الأصوليين في مسألة مقاصد الشريعة، وبيان طريقتهم في تناولها من خلال استقراء كلامهم فيها، وكذلك الاعتماد على المنهجين الاستدلالي والتحليلي النقدي؛ حيث أقوم بذكر أقوال الأصوليين والفقهاء في المسائل الأصولية والفقهية، مع ذكر أدلة كل قول، ومناقشتها مناقشة علمية، وصولا إلى الراجح من الأقوال في المسألة، قد خلصت إلى عدة نتائج أبرزها هو أن المقاصد الشرعية هي غايات الشارع من الأحكام الشرعية تحقيقا للعبودية، وتقريرا لمصالح العباد في المعاش والمعاد. وأنها تقوم على جلب المصالح ودرء المفاسد، وأن جميع أحكام الشريعة تقوم على حفظ الضروريات والحاجيات والتحسينات.

The main objective of Islamic Sharia is to maintain discipline in the world and control the behavior of people in a way that prevents corruption or decay. Hence, this objective can be achieved by through seeking interests and avoiding vices in terms of the true meaning of interests and vices. Moreover, the legitimate purposes constitute the ultimate end of the prescribed provisions as ordained by Allah to achieve servitude and acknowledge the best for the worshippers in this life and the hereafter. The objectives of Islamic Sharia are based upon the concept of averting the means of corruption is given priority over bringing benefits. In addition, all the provisions of Sharia rely on preserving the necessities, satisfying the needs and improvements. As for the penalties of the prescribed provisions, they are ordained by Allah so that there is no space for diligence. Those prescribed provisions include the penalties of adultery, defamation, drinking wine and apostasy. According to the nature of this topic, this research applies the inductive approach where the researcher has read the statements of the jurists and fundamentalists related to the juristic and fundamentalist issues with reference to the evidence of every category, discussing them academically seeking the preponderant statement on every issue. To conclude, the research has reached some outstanding findings such as the legitimate purposes constitute the ultimate end of the prescribed provisions as ordained by Allah to achieve servitude and acknowledge the best for the worshippers in this life and the hereafter. Moreover, they are based upon the concept of averting the means of corruption is given priority over bringing benefits. Finally, all the provisions of Sharia rely on preserving the necessities, satisfying the needs and improvements.
