المستخلص: The rights of the accused are among the basic and fundamental rights that the international organization has established after a long struggle in a set of international and regional conventions related to human rights and then through stipulating it in national constitutions. The criminal laws have come to provide the basic guarantees for the accused when he is exposed to an accusatory position, by the public authorities, these rights that provide a person with a great sense of reassurance against all arbitrary acts, such as arrest, imprisonment, search, coercion, or punishment, these illegal acts are practiced in a manner that contradicts the human rights system, especially during the research and investigation stage before the trial. The current Moroccan Constitution has stipulated a set of basic guarantees for individual rights and freedoms, and the Criminal Procedures Law includes the rules that regulate how to preserve these rights and ensure that the authority is not arbitrary when it undertakes legal procedures that affect personal freedoms, keeping pace with the political and human rights changes experienced by both the society and the political system in Morocco. This article will try to answer the question to what extent has the Moroccan legislation met the international requirements of a fair trial?
