إن علم أصول الفقه من أدق وأجل العلوم الشرعية، ومن أدق هذا العلم مباحث القياس، وأدق مباحث القياس مباحث العلة، وأدق مباحث العلة قوادحها، هدفت الدراسة لتبين حقيقة العلة وقوادحها. وتظهر أهمية الدراسة في كونها تجلي الجهود المبذولة من علماء الأصول في بيان قوادح العلة الشرعية وربطها بالأحكام وجودا وعدما. وتتمثل مشكلة الدراسة في التباين الواضح والخلاف الجلي بين علماء الأصول بين مؤيد ومعارض ومتوقف لقوادح العلة، وأنها من علم الجدل والكلام. اعتمدت الدراسة على المنهج الاستقرائي التحليلي التتبعي تتبعت فيه آراء علماء الأصول وعزوها لمصادرها الأصلية، وتوصلت في نهاية الدراسة لجملة من النتائج منها: أن لقوادح العلة أهمية بالغة في باب القياس إذ إنها تعتبر وسيلة من وسائل صلاحية الحكم الشرعي وتحققه لما يترتب على تشريع الحكم عندها تحقيق مصلحة مقصودة للشارع أو دفع مفسدة.
The science of Usul Al-Fiqh is one of the most accurate and up-to-date legal sciences, and among the most accurate of this science is the investigation of analogy, the cause investigations, and the most accurate investigations of the cause and objections to it .The importance of the study appears in that it reflects the efforts made by the scholars of origins in explaining the triggers of the legal cause and linking it to the rulings, whether or not .The problem of the study is represented in the clear discrepancy and clear disagreement between the scholars of origins, who support, oppose and stop the deflectors of the bug, and that it is from the science of controversy and speech .The study relied on the inductive and analytical consecutive method, in which it tracked the opinions of the scholars of origins and attributed them to their original sources .At the end of the study, I reached a number of results, including: that the objections of the cause is great importance in the section of analogy .As it is considered one of the means of the validity of the legal ruling and its verification, because the legislation of the ruling then leads to the achievement of an intended interest for the lawmaker or to avoid corruption.
