المستخلص: This Research studies the convention and customs and their relationship with the objectives of Islamic law. It has been divided into three sections, the first includes concepts and terms of the study. The second deals with convention and customs and their relationship to the method of reasoning and worship in the Islamic law. And the third discusses convention and customs and their relationship to interests and evils. The Research tried to answer the following questions: What is the role of convention in achieving the noble goals of Sharia? What is the relationship between customs and the noble goals of Sharia? The researcher has concluded that there is a relationship between convention and customs and the noble goals of Sharia. Customs play a role in the fulfilment of the Sharia objectives. After all, interest is usually one of the customs, and it has been proven that the Divine Law has considered the interests of people, and their convention and customs. Hence, the jurist must observe convention and customs in ruling.

يدرس هذا البحث العرف والعادات وعلاقتها بمقاصد الشريعة الإسلامية، وقد تم تقسيمه إلى ثلاثة مباحث، الأول: مفاهيم ومصطلحات الدراسة، الثاني: العرف والعادات وعلاقتها بمنهج التعليل والتعبد في الشريعة الإسلامية. والثالث: العرف والعادات وعلاقتها بالمصالح والمفاسد. وقد حاول البحث الإجابة على التساؤلات الآتية: ما هو دور العرف في تحقيق مقصد الشارع؟ وما هي العلاقة بين العرف ومقاصد الشريعة؟ وقد توصل الباحث إلى وجود علاقة بين العرف ومقاصد الشريعة، ودور العرف في تحقيق مقصد الشارع، على اعتبار أن المصلحة عادة من العادات، وقد ثبت أن الشارع قد راعى مصالح الناس، ومن بينها اعتبار أعرافهم وعاداتهم في التشريع، ولذا وجب على الفقيه مراعاة العرف والعادة في الحكم، بما ينسجم مع تحقيق مقصد الشارع.
