المستخلص: تسهم قوانين وتشريعات البناء في ضبط وتنظيم البناء داخل المجتمعات، وهو دور أساسي لضمان تطبيق الاشتراطات البنائية، وتوحيد النمط العمراني للمدن، وهو ما يمثل الهدف الرئيسي لسن قوانين وتشريعات العمارة والعمران. وقد أسهمت القوانين والتشريعات في تحقيق هذا الهدف إلى حد كبير إلا أنها لم تتمكن من حث الملاك، وأصحاب المشروعات على الحرص على إضافة أبعاد تكسب مشروعاتهم ميزات خاصة، كالحفاظ على الهوية، أو الطابع، أو إدراج المشروعات ضمن قوائم تصنيف المباني الخضراء. ويرجع ذلك إلى عدم احتواء تلك القوانين على محفزات لتشجيع أصحاب المشاريع والمعماريين على إضافة تلك الأبعاد، كما أغفلت العديد من الجوانب البيئية للعمارة، أو حقوق الارتفاق والهوية الثقافة، وأدت في مجملها إلى فصل المجتمع عن عاداته وتقاليده وإرثه الحضاري، وهي معايير هامة لدعم مبادئ العمارة الخضراء. لذا، تأتى الورقة البحثية كمحاولة جادة لحث المشرعين على تفادى الأخطاء المؤدية إلى اغتراب العمارة عن مجتمعاتها، وعدم مراعاتها لمحيطها البيئي، وتوجيه القوانين نحو تحفيز أصحاب المشروعات والمعماريين؛ لإضافة أبعاد بيئية واجتماعية إلى مشروعاتهم من خلال استعراض الأخطاء الراهنة بقوانين البناء، وطرح أفكار لتشجيع وحث متخذي القرار على المساهمة في انتشار تطبيقات العمارة الخضراء داخل المدن الجديدة التي تمثل نواة عمارة المستقبل؛ لكي تتمكن من مواجهة التحديات التي باتت تقرع الافاق. ليخلص البحث إلى مجموعة من التوصيات لأهم النقاط الواجب تعديلها بقوانين البناء الحالية وفى مقدمتها الاشتراطات البنائية بقانون البناء الموحد، وأهم النقاط الواجب إضافتها؛ لتشجيع متخذي القرار من الملاك والمعماريين للتوجه نحو العمارة الخضراء التي باتت مطلب ضروري لمواجهة تحديات المستقبل.

The codes and legislation of building contribute to the control and regulation of building inside the societies. It is considered the main role to ensure applying the building requirements and standardize the urban style of cities. It represents the main aim of the enactment of codes and legislation of architecture and Urban. Despite the codes and legislation that have contributed to achieving this aim to the limit, but have not able to encourage the owners and entrepreneurs to concern for adding dimensions that give significant features for their projects such as Preservation of identity, character, inclusion of projects in green architecture classification lists. it was due to those codes did not contain incentives to encourage entrepreneurs and architects to add these dimensions, as well as, a lot of the environmental aspects for architecture or easement rights and cultural identity have overlooked and led to the separation of the society from its customs, traditions and civilizational heritage which are considered the important standards to support the principles of the Green Architecture. therefore, this paper is considered as a serious attempt to induce the legislators avoiding the errors that lead to the alienation of architecture from their societies, without taking account of its surrounding environment, directing the codes towards stimulating the entrepreneurs and architects to add the dimensions of social, environmental to their projects through reviewing the current errors about the building codes and providing the ideas about encouraging and inducing the decision-makers to contribute in spreading the applications of green architecture inside new cities which represent the core of future architecture in order to face the challenges that have now become imminent. in the conclusion of the search, there is an outline of the set of recommendations of the most important points which must modify by the current building codes, foremost among which the building requirements under the Uniform Building By-Laws and the most important points to add to encourage the decision-makers either owners or architects to head toward the green architecture that became a necessary requirement to face the challenges of the future.
