المستخلص: سعت الدراسة لبحث إشكالية الكشف عن المرتكزات المقاصدية لحماية الأوطان متمثلة بالمقاصد الكلية التي جاء الإسلام لتحقيقها، وبما أثر في الوحيين، مما يمكننا من استنباطها لما تتصف به من العموم والديمومة، واستجلاء أهميتها في تحقيق حماية الأوطان وقيم المواطنة، وتقريرها واقعا معاشا في حياتنا المعاصرة، بناء على أن هذه المرتكزات مستقاة من الشريعة الإسلامية الغراء، ولاسيما مما ورد من نماذج تطبيقية في السنة النبوية المشرفة. وقد قامت الدراسة بتتبع ما ثبت من أصول مقاصدية وتطبيقاتها العملية في التشريع الإسلامي، والعمل على تصنيفها ضمن أطر معرفية معاصرة، سعيا لإبراز تلك الأسس والمقومات، وصياغتها بشكل ينسجم مع مقتضيات عصرنا، وبما يمكننا من اعتبارها أنموذجا يحتذى به، ومرتكزا لتغيير واقع مجتمعاتنا للأفضل، ومن ثم صياغتها وفق رؤية موضوعية شاملة للبناء الحضاري المقصود، بما يخدم أمن أوطاننا ويحفظ لها استقرارها ونماءها. ولاريب أن استخلاص هذه المرتكزات المقاصدية المبثوثة في الكتاب والسنة النبوية المشرفة وترتيبها وفق أطر منهجية محددة، يجيب عن إشكالية الدراسة. وللوصول لهذه الغايات والأهداف استلزم الأمر التعريف بمقاصد أحكام حماية الوطن، لما لها من أهمية عظيمة وفوائد عميمة، وكيف يمكن للفهم المقاصدي أن يخدم قضايا الإنسان، ويحقق التنمية الحقيقية للمجتمع، وارتباط الغاية المقاصدية بخدمة الإنسان، والحفاظ على حياته وكرامته مصانة؛ وهو ما يمكن أن يتحقق من خلال العناية بجانب القيم والمصالح المعتبرة التي تعد عمد هذا الفهم وأسسه، والمسوغات والضرورية لوجوده.

The study sought to examine the problem of revealing the pillars of intent to protect the homeland, represented by the total purposes that Islam came to achieve, and the impact of the two revelations, which enables us to derive from what is characterized by the general and permanent, and to clarify its importance in achieving the protection of homelands and citizenship values, and determine a living reality in our contemporary life. Based on the fact that these pillars are derived from Islamic law glue, especially from the reported models applied in the Prophet’s Sunnah. The study followed the proven origins of Makassedi and its practical applications in Islamic legislation, and classified them within contemporary knowledge frameworks. In order to highlight these foundations and elements, and formulated in a manner consistent with the requirements of our time, and so that we can be considered as a role model, and based on changing the reality of our societies for the better, and then formulated according to a comprehensive objective vision of the intended civilized construction, in order to serve the security of our homelands and preserve its stability and development. There is no doubt that the extraction of these pillars of intent in the book and the Sunnah and arrange them according to specific methodological frameworks, answer the problem of the study. To reach these goals and objectives, it was necessary to define the purposes of the provisions of the protection of the homeland, because of their great importance and general benefits, and how the purposes of understanding can serve human causes, and achieve the real development of society, and the linking of the purpose of the purpose of serving the human being, and preservation of his life and dignity is preserved; It is achieved by taking care of the values and interests that are considered the pillars of this understanding and the rationale for its existence.
