المستخلص: The Algerian legislator determines the competence by issuing an order of recognition and execution of the International Commercial Arbitral Award for the President of the competent Court. The latter issues orders in the framework of his administrative work and orders in the framework of his judicial work. Much controversy has been generated over the legal nature of this order in the event that the legislator does not clarify the form in which the order for recognition and execution is issued. Between those who consider it to be an administrative act issued under the form of a referee’s order and those who consider it to be a judicial act issued by an emergency interlocutory- injection. Each party presented the arguments which support and confirm its position, and it was ultimately clear that all of these justifications contain an aspect of validity, showing that the recognition and execution of the International Commercial Arbitral Award take on some of the characteristics of the administrative order in terms of authenticity and the means of appeal against it, which makes it of a double or complex legal nature which mixes administrative and judicial work.

يسند المشرع الجزائري الاختصاص بإصدار أمر الاعتراف وتنفيذ حكم التحكيم التجاري الدولي لرئيس المحكمة المختصة، وهذا الأخير يصدر أوامر في إطار عمله الولائي وأوامر في إطار عمله القضائي، وفي ظل سكوت المشرع عن توضيح الشكل الذي يصدر فيه أمر الاعتراف والتنفيذ، فقد ثار جدل حول الطبيعة القانونية لهذا الأمر، بين اتجاه مؤيد لكونه عمل ولائي يصدر في شكل أمر على عريضة واتجاه آخر مؤيد لكونه عمل قضائي يصدر في شكل أمر استعجالي. وقد قدم كل اتجاه المبررات التي تدعم وتؤكد موقفه، وتبين في الأخير أن جميع هذه المبررات تحتوي على جانب من الصحة، الأمر الذي يظهر من خلاله أن أمر الاعتراف وتنفيذ حكم التحكيم التجاري الدولي يأخذ بعض خصائص الأمر الولائي من حيث الشكليات والإجراءات وبعض خصائص الأمر القضائي من حيث الحجية وطرق الطعن الممارسة ضده، وهو ما يجعله ذو طبيعة قانونية مزدوجة أو مركبة تمزج بين العمل الولائي والقضائي.
