|a عنوان البحث: الالتزام التضاممي في النظام السعودي (دراسة تطبيقية مقارنة) موضوع البحث: الالتزام التضاممي وموقف القوانين وأحكام القضاء المقارن وتطبيقاته في النظام السعودي. منهج البحث: أعتمد البحث المنهج الوصفي التحليلي المقارن لفكرة الالتزام التضاممي مع إبراز أهم التطبيقات النظامية. الأقسام الرئيسة للبحث: تم تقسيم البحث إلى تمهيد وفصلين رئيسيين: حيث تناول ماهية الالتزام التضاممي، وشروط تحققه وآثار الالتزام التضاممي وتطبيقاته. أبرز نتائج البحث: التضامم نظام مستقل يختلف عن التضامن في بعض الشروط والآثار، ولا يقل عنه أهمية في ضمان حق الدائن. يقوم الالتزام التضاممي نتيجة اجتماع عدة عناصر وهي: تعدد الملتزمين ووحدة الدائن ووحدة المحل أو وحدة الدين مع تعدد مصادر الالتزام. تكشف التطبيقات القضائية في المملكة عن الاعتراف بالمسؤولية التضاممية رغم عدم استخدام المصطلح. أبرز التوصيات: على المنظم السعودي معالجة الالتزام التضاممي تحت عنوان واضح ومشتمل لجميع شروطه الخاصة، وجمع المواد المتناثرة في الأنظمة، وأحكامه في الفقه الإسلامي. العمل على إنجاز مشروع النظام المدني السعودي، وإفراد فصل خاص للتمييز بين الالتزام التضامني والتضاممي.

|b Research title: Collaborative commitment in the Saudi system (comparative applied study). Research topic: Collaborative commitment, the position of laws and comparative judiciary provisions and their applications in the Saudi system. Research methodology: The research adopted the descriptive, analytical and comparative approach to the idea of collaborative commitment while highlighting the most important systemic applications. The main divisions of the research: The research was divided into an introduction and two main chapters: it dealt with the nature of the collaborative commitment, the conditions for its achievement, the effects of the collaborative commitment and its applications. The most prominent findings of the research: Al-Taḍamum (Collaborative) is an independent system that differs from al-Taḍamun (solidarity) in some terms and effects, and is no less important in securing the creditor's right. The collaborative commitment is based on the combination of several elements, namely: the multiplicity of obligors, the unity of the creditor, the unity of the property or the unity of the debt with the multiplicity of sources of commitment. Judicial applications in the Kingdom reveal the recognition of collaborative responsibility, although the term is not used. The most prominent recommendations: The Saudi regulator should address the collaborative commitment under a clear title that includes all of its special conditions, and collect the materials scattered in the regulations, and its provisions in Islamic jurisprudence. To work on the completion of the Saudi civil system project, and the establishment of a special chapter to distinguish between al-Taḍamum (the collaborative) and al-Taḍamun (solidarity) commitment.
