|a إن علم أصول الفقه من خلال تقعيد قواعده مثل منهجا مقصديا يبتغي توجيه ملكة الاجتهاد عند الباحثين في العلوم الشرعية، حيث أسس به العقل الإسلامي منهجا فلسفيا شرعيا قادرا على الاجتهاد لاستنباط الأحكام في جميع مجالات البناء الحضاري في الفكر الإسلامي، وبذلك تضمن هذا العلم فوائد مهمة، لا يمكن الاستغناء عنها أو التقليل من أهميتها. يهدف البحث إلى الرد على منهجين في الاجتهاد، أولهما منهج ألغى الواقع من الاعتبار فتمسك بالأحكام الجزئية في النصوص الشرعية دون مراعاة الكليات في التنزيل، ومنهج آخر أولى مرجعية الواقع على النص فسلب الوحي قدسيته وجعله جزءاً من التراث الإسلامي دون تمييز لمكانته. يسعى هذا البحث لإعادة التوازن لما انفرط من تفكير هؤلاء وهؤلاء، وذلك ببحث معالم مرجعية الواقع في الاجتهاد والفتوى من خلال تلمس هذه المرجعية في فقه الدليل الشرعي أولا، ثم بيان معالم هذه المرجعية في منهجية الاستدلال ثانيا، قصد الاستعانة بذلك في فقه التنزيل.

|b The science of the fundamentalist Method based on rules formation represented a purposeful methodology that seeks to direct the ijtihad skill for researchers in the Islamic sciences, where the Islamic mind established a legitimate philosophical approach that capable of ijtihad to derive rulings in all areas of civilized construction in Islamic thought, and thus this science contained important benefits, irreplaceable or underestimated. The research aims is to refuting two groups whose method has already spread all over the world, a group that eliminated the reality from its consideration and adhered to some parts of the shariah texts without even looking the complete texts, and another group denied the shariah text and made the reality as their source and deprived the revelation from its sanctity and made it part of the Islamic heritage without distinguishing its status. This research seeks to restore balance to what has been unbound of the thinking of these groups, firstly by examining the parameter of the reference reality in jurisprudential in understanding the shariah proof, and secondly by explaining the symbols of this reference in the jurisprudential reasoning, to recourse with that in the jurisprudence of the revelation.
