|a الابتكار يقاس به مدى تخلف وتقدم الدول، وأصبحت حماية هذه الابتكارات بقواعد الملكية الفكرية ضرورة ملحة، وتعد حافزا يشجع الإنسان على الابتكار والإبداع، وتقوية الحماية تدفع عجلة التجارة، الدولية إلى الأمام حينما توفر مناخا مستقرا من أجل تبادل منتجات الملكية الفكرية، وان هذه الابتكارات هي نتاج الفكر الإنساني وهي خاصة بالمبتكر وحده دون غيره مما أدى اللي الاعتراف به وحمايته تحت مظلة الملكية الفكرية من خلال قواعد قانونية صارمة تنظم هذه الملكية وتحميها ومن ثم تقرر الحقوق والضمانات لأصحابها.
