المستخلص: تهدف هذه الدراسة إلى تتبع أسباب التخلف الاقتصادي في البلاد الإسلامية ودور الفقه الإسلامي في معالجته. وقد توصلت الدراسة بأن السبب الرئيس للتخلف الاقتصادي هو سوء توزيع الثروة مما نتج عنه سوء استغلال الموارد الاقتصادية. وتوصل الباحث من خلال الدراسة إلى خطأ نظرية (مالتس) السكانية والتي بينت الرأسمالية نظرتها للتخلف الاقتصادي والمشكلة الاقتصادية عليها حيث اعتبرت أن سبب المشكلة الاقتصادية والتخلف الاقتصادي هو انتفاء التوازن بين حجم السكان من جهة والموارد الاقتصادية المتاحة من جهة أخرى إضافة إلى بعض العوامل الاقتصادية والسياسية الأخرى. وقد تبين للدارس أن علاج النظام الرأسمالي لهذه المشكلة والمتمثل بزيادة حجم الإنتاج والدخل الأهلي دون النظر والأخذ بعين الاعتبار لتوزيع الثروة، زاد الطين بلة وتفاقمت مشكلة الجوع، حيث تجاوز عدد الجياع حسب آخر التقارير (840) مليون إنسان في العالم غالبيتهم في العالم الثالث، وهذا الرقم يتزايد يوما بعد يوم. إن الإسلام نظر إلى المشكلة نظرة منظومية فتوصل إلى أن سبب المشكلة هو سوء توزيع الثروة نتج عنه سوء استغلال الموارد الاقتصادية، وقد عالج الإسلام المشكلة من خلال منظومة من الأحكام الشرعية عالجت أسباب ملكية الموارد وأحكام العمل فيها، وعملت على إزالة كل الحواجز والمثبطات التي تحول بين الإنسان والعمل والإنتاج، وربط أجرة الأجير بالمنفعة التي يقدمها مما يفرض عليه تعلم أرقى أساليب وفنون الإنتاج. وقد توصل الباحث إلى أن التخلف الذي أصاب العالم الإسلامي سببه غياب الإسلام وأحكامه عن حياة المسلمين.

The Role of Islamic Legistlation (Fikih) for the Treatment of the Economic Back wording in Islamic Countries (Systematic View) This study aims to follow the causes of the economic backwording in the Islamic countries and the role of Islamic legistlation in its treatment. The study reached to the fact that the main cause in this backwording is the misdistribution of the wealth which results to the inmistrument of the economic resources. The study reached to the wrong view of the Maltus population theory upon which capitalism has built its view for economic backwording and the economic problem. The Maltus theory considered that the cause of the economic problem and the backwording lies in the non balance between the volume of the population and the available economic resources in addition to the other political and economic factors. The study showed that the treatment of the capitalism to this problem, presented in the increase of the production and the income despite pf the wealth distribution! increased the water to the mud and to the elevation of the starving. The starvation population reached according to the last reports to around (840) million human where the majority are in the 3rd world .This number increase day after day. Islam looks to the problem as a whole and reached that the cause is the misdistribution of the wealth which resulted to the misexploitahon of the economic resources. Islam treated the problem through a group of Islamic legislations which treated the causes of the resources ownership and the rules for its application. Islamic has worked to remove all obstacles which stops between humans and the work and the production. Islam bonded the wages with the benefits of the work and hence subjugate human to learn and follow the modem methods and arts of production. This research come to the fact that the cause of the backwording in the Islamic world has resulted from the abandon of the Islamic rules from the muslems life.
