لقد اعتنى الأصوليون بالاستدلال بالقرآن الكريم على المسائل الأصولية، وكان من دقة استنباطهم أن يستدلوا بالآية الواحدة على مسائل متعددة، مع اختلاف أوجه الاستدلال في كل مسألة، ومن تلك الآيات التي تعدد استدلالهم بها في مواطن مختلفة، قوله تعالى: (وَلِلَّهِ عَلَى النَّاسِ حِجُّ الْبَيْتِ مَنِ اسْتَطَاعَ إِلَيْهِ سَبِيلً)، ولذا وقع الاختيار عليها لتكون موضوع هذا البحث، والقصد من ذلك: جمع استدلالات الأصوليين بهذه الآية الكريمة في المسائل الأصولية، وما ورد على تلك الاستدلالات من مناقشات، وأجوبة، وبيان الموقف منها. وقد وجدت الأصوليين استدلوا بهذه الآية في ثنتي عشرة مسألة أصولية، هي: أسباب الأحكام، وتكليف الكفار بفروع الشريعة، وإجماع أهل المدينة، ونسخ الأخف بالأثقل، والبيان بالفعل، وتأخير البيان عن وقت الخطاب إلى وقت الحاجة، والتدرج في البيان، ومقتضى صيفة الأمر، واقتضاء الأمر المطلق للتكرار، واقتضاء الأمر المعلق بشرط للتكرار، وتخصيص العام بالعقل، وحجية العام بعد التخصيص.
The theoreticians of Islamic Jurisprudence were keen to de¬rive evidence from the Qur'an about the Fiqhi theoretical issues. They were so precise that one verse can be taken as evidence for multiple questions, bearing in mind the different inferences in each question. One of these verses used as an evidence for different questions is Allah’s saying, “And [due] to Allah from the people is a pilgrimage to the House - for whoever is able to find thereto a way”. Therefore, it was chosen as the topic of this paper in an attempt to collect the inferences of the theoreticians on this holy verse about the Fiqhi theoretical issues and their related arguments, answers and approaches. I found out that the theoreticians of Islamic Jurisprudence used this verse as an evidence for twelve theoretical questions. They include the reasons for rulings, the assigning non-Muslims to abide by Shari’ah tenets, consensus of Madinah dwellers, abrogating the little by the immense, demonstrating by actions, delaying the demonstration on the time of utterance when it is needed, graduality of demonstration, the implication of the imper¬ative form, the unrestricted imperative form denoting repetition, the conditional imperative form denoting repetition, limiting the general by reason, and the binding force of the general ruling after the specific.
