|a اعتمدت الدولة الجزائرية على صيغة جديدة تتضمن أحكام عقدي البيع والإيجار لمواجهة عجز قطاع السكن عن تلبية حاجيات المواطنين، تعرف بالبيع بالإيجار إذ يعد من بين أحد أشكال البيوع الائتمانية التي دعت إليها حاجة الأفراد. عقد البيع بالإيجار عقد مركب فهو ذو طبيعة خاصة تجتمع في طرفيه صفتين حيث يبدو المالك كالبائع أو المؤجر ويبدو المستفيد كمشتر أو مستأجر في الوقت نفسه. ولما كان عقد البيع بالإيجار من العقود الملزمة للجانبين فهو يرتب مجموعة من الالتزامات التي تحكمها القواعد العامة المتعلقة بالبيع وبالإيجار.

|b The Algerian state has adopted a new formula that includes the provisions of the sales and rent contracts to cope with the inability of the housing sector to meet the needs of citizens. It is known as selling by rent, as it is one of the forms of affiliate sales called for by the needs of individuals. A lease sale contract is a complex contract, as it is of a special nature that meets at both ends of the two terms where the owner appears as a seller or lessor at the same time. And since the lease sale contract is a binding contract for both sides, it arranges a set of obligations that are governed by the general rules relating to sale and rent.
