المستخلص: أن القيم الإنسانية انعكست على العمارة الاسلامية وكان من اهمها (الخصوصية – حقوق الجوار- التكافل الاجتماعي – الوسطية – المساواة- الصدق في التعبير- القيم الجمالية) - وقد اهتم الدين الاسلامي بحقوق الجوار والتكافل الاجتماعي لما لهم من تأثير كبير على العقيدة الاسلامية. حيث يحتاج الأفراد والجماعات إلى حقوق الجوار كمطلب من متطلبات حياتهم اليومية ومن هنا كان ارتقاء العلاقات الإنسانية نتيجة هذه القيمة فتحقق الأمن والأمان والسكينة التي حرص الإسلام على إرسائها بين المسلمين بعضهم البعض أو بين المسلمين وغيرهم من الديانات الأخرى. فقد قال رسول لله (صلى لله عليه وسلم): "مازال جبريل يوصيني بالجار حتى ظننت أنه سيورثه" (عن ابن عمر وعائشة – متفق عليه)، فتميز النمط المعماري والعمراني في المدينة الإسلامية بأنه انعكاس مادي للعلاقات الإنسانية التي أرساها الإسلام منذ مئات السنين فتكونت قاعدة اجتماعية قوية ومتلاحمة تعبر عن ترابط الجيران بعضهم ببعض في إطار من المعرفة الجيدة للحقوق والواجبات النابعة من العقيدة الإسلامية. ومن هنا كانت هذه الورقة البحثية لدراسة مدى انعكاس حقوق الجوار على التشكيلات العمرانية والمعمارية في العصور الإسلامية من خلال تحليل مستويات تحقيق حقوق الجوار بالعمارة الاسلامية. لذلك تم عمل دراسة مقارنه لأنواعا حقوق الجوار والتي من أهمها: حق الارتفاق، حق الشفعة، حق المطل، حق الملكية، حق الضرر، حق الارتفاع، حق استخدام الحوائط المشتركة، حق استخدام العناصر المشتركة لضمان تحديد نوع النزاع القائم وهذا جانب له أهمية عظيمة في دراسة أنسب وسائل التنظيم العمراني، أو أقربها لتحقيق عمران ناجح ومستقر ومتفاعل مع المجتمع.

The human values were reflected in Islamic architecture, and the most important of them were (privacy - the rights of neighborliness - social solidarity - moderation - equality - honesty in expression - aesthetic values) - Islam has paid attention to the rights of the neighborhood and social solidarity because of their great influence on the Islamic creed. Where individuals and groups need the rights of neighborliness as a requirement of their daily lives, and hence the rise of human relations as a result of this value, achieving the security, safety, and tranquility that Islam has been keen to establish between Muslims or between Muslims and other religions. The Messenger of Allah (may Allah's prayers and peace be upon him) said: "Jibril kept recommending treating neighbors with kindness until I thought he would assign a share of the inheritance." (on the authority of Ibn Omar and Aisha - agreed upon), so the architectural and constructional style in the Islamic city was distinguished as a material reflection of the human relations established by Islam hundreds of years ago. It formed a strong and cohesive social base that expresses the interrelationship of neighbors with each other within a framework of good knowledge of the rights and duties stemming from the Islamic faith. Hence, this research paper was designed to study the extent to which neighborhood rights are reflected on the constructional and architectural formations in Islamic times by analyzing the levels of achieving neighborhood rights in Islamic architecture. Therefore, a comparative study of the types of neighboring rights was conducted, the most important of which are: the right of easement, the right of Shufa (preemption), the right of overlooking, the right of ownership, the right of damage, the right of height, the right to use common walls, the right to use the common elements to ensure the identification of the type of existing conflict and this aspect is of great importance in Studying the most appropriate means of architectural planning, or the closest to achieving a successful, stable and interactive architecture with the community.
