المستخلص: تقوم وفكرة البحث على حل عدد من المشكلات البحثية المتعلقة بموضوع الاستحلال، ومن أهمها: بيان مفهوم الاستحلال وإطلاقاته المتعددة في النصوص الشرعية، وتحديد المناط الموجب للكفر الأكبر في قضية الاستحلال، وإقامة الأدلة على صحته، ومناقشة الأقوال الخاطئة في تحديده ونقد أدلتها. وتكمن أهمية البحث في مسألة التكفير بالاستحلال في خطورة باب التكفير واحتياجه الشديد إلى الدراسات الشرعية المؤصلة، وفي كثرة الإشكال والغموض في مسألة الاستحلال، وخفاء المناط الموجب للتكفير والردة فيها، وفي انتشار تطبيقات معاصرة عديدة منبثقة من الغلط في تحديد المناط الموجب للتكفير في قضية الاستحلال. وقد سلكت في معالجة مسائل البحث وفقراته عددا من المناهج، وهي: منهج الاستقراء، والتحليل، والنقد. ومن أهم نتائج البحث: أن لفظ الاستحلال يطلق في النصوص على عدد من الإطلاقات، وأن التكفير بالاستحلال لا يكون إلا بما في القلب، وأن الأعمال والأقوال لا تكون دالة بنفسها على الاستحلال، وأن كفر الاستحلال يرجع في حقيقته إلى كفر التكذيب.

The research idea is based on solving a number of research problems related to the topic of Istihlal(1)From the most important problems: Explaining the concept of Istihalal and its different names in Islamic texts And determining the determinant cause of disbelief (al kofr al akbar) in the issue of Istihall And establishing the evidence of its authenticity and discuss the various faulty alternative viewpoints in identifying it and criticizing its evidence. The importance of this study: The importance of research on the issue of takfīr (2) for committing Istiḥlāl lies on Danger of the issue of takfīr and its strong need for authentic Sharia studies And much obscurity and confusion overshadows the topic of Istiḥlāl. And the Invisibility of the determinant cause of takfir and apostasw While committing Istiḥlāl. And there is an ever-growing spread of faulty contemporary opinions pertaining to this topic, that stem out of their error in identifying the determinant cause that renders the act of Istiḥlāl constitutes major disbelief and apostasy .The methodology employed in this article :In this study, I employed a variety of research methodologies by adopting inductive, analytical, and critical approaches .The most important learnings : The most important learnings of this study are that Istiḥlāl, as a term, is used in a variety of ways or meanings in Shariah. Takfīr for the act of Istiḥlāl can only be done if it is proven that the individual believes in the Istiḥlāl in his heart, and that mere actions and speech on their own do not suffice in determining that Istiḥlāl has truly taken place And that The disbelief of Istiḥlāl Is due in fact to denial disbelief (Kufr at-Takdhīb).
