|a البحث هو دراسة لقاعدة: (الفضيلة المتعلقة بنفس العبادة أولى من الفضيلة المتعلقة بمكانها) دراسة نظرية تطبيقية؛ لأن العلماء الذين ذكروا هذه القاعدة لم يكتبوا فيها من حيث بيان معناها لغة واصطلاحا، ولا من حيث بيان حجيتها، والأدلة على صحة الاحتجاج بها، ولا من حيث بيان شروط تطبيقها، فقمت ببيان ذلك، مع جمع الفروع الفقهية المندرجة تحتها، والمتناثرة في مؤلفات العلماء، وبيان وجه دخولها تحت القاعدة، ومناقشة الفروع التي أدخلت تحت القاعدة وهي غير داخلة. وكان منهجي في كتابة البحث استقرائيا فيما يتعلق بالرجوع إلى مصادر البحث، ووصفيا تحليليا فيما يتعلق بدراسة مسائله ومناقشتها. وكان من أهم نتائج البحث ما يلي: 1- معنى القاعدة: أن العبادة إذا دار فعلها بين مكانين: فاضل ومفضول، وإذا فعلت في المكان المفضول حصل فيها من الصفات المرغوبة المتعلقة بنفس العبادة، ما لم يحصل فيها فيما لو فعلت في المكان الفاضل، ففعلها في المكان المفضول أولى. 2-من العلماء من ذكر القاعدة مقتصرا على المفاضلة فيها بين ما يتعلق بنفس العبادة وما يتعلق بمكانها، ومنهم من فاضل فيها بين ما يتعلق بنفس العبادة وما يتعلق بمكانها أو زمانها، ولا شك أنه يثبت لزمانها ما ثبت لمكانها من حكم؛ لأن المكان والزمان سواء من حيث كونهما أوصافا للعبادة وليسا من ذاتها. 3-القاعدة احتج بها كثير من العلماء، وقد دل على حجيتها عدة أدلة ذكرتها في البحث. 4-يشترط لتطبيق القاعدة أربعة شروط، ذكرتها في البحث. 5-أنبني على هذه القاعدة كثير من الفروع الفقهية، ذكرت طائفة منها في البحث.

|b The research is a study of the rule: (The virtue related to the same worship is more important than the virtue related to its place) Because the scholars who mentioned this rule did not talk about it extensively. So I talked about it. My methodology in writing the research was inductive with regard to reference to the research sources, and descriptive and analytical with regard to studying and discussing its issues. Among the most important results of the research were the following: 1- The meaning of the rule: that if worship is performed between two places: virtuous and preferred, and if it is performed in the preferred place, there will be desirable qualities related to the same worship, unless it takes place in it if it is done in the virtuous place, so doing it in the preferred place is first. Some of the scholars mentioned the rule confined to the comparison therein between what is related to the same worship and what is related to its location, and some of them are superior in it between what is related to the same worship and what is related to its place or time, and there is no doubt that the ruling on its place is proven in its time. Because they are equal in that they are descriptions of worship and are not of themselves. The rule was cited by many scholars, and its authority was evidenced by several evidence that I mentioned in the research. To apply the rule four conditions are required, which I mentioned in the research. Many jurisprudential branches are based on this rule, a group of which I mentioned in this research.
