|b Given the importance of the family in Islamic legislation, its essential function and its great responsibility in building the Islamic nation, the research showed some of this divine legislation and how it gave it a special and distinct place as the key pillar in the formation of the great Islamic society. Which ultimately results in a gathering of families that collectively constitute the same society and then the great human society. In view of the importance of this topic, the research focused on explaining one of the fundamental aspects of its rights within the system of rights defined by Islam: "the right of the child", "the right of the wife", "the right of the mother" and the "right of the father", considering that each of these rights has a role to play in ensuring the building of a secure, committed and cohesive family. Moreover, these rights are a divine grant and not born of reason, nature or law with an objective view and a proper place within this system of the Just Lord, and that these rights are among the foundation of a stable, cohesive and strong family. The research also discussed the importance of the psychological and spiritual factors in the formation of family relationships, focusing on the element of marriage advocated by common sense and universal nature, in addition to the associated rights and duties between men and women, such as taking into account the time of consummation, respect for feelings between them, good dealing, communication, understanding, etc. All this in order to achieve legitimate objectives, namely, to reach the level of a family adjustment, solidarity, cooperation and love among each other, which is flooded with love, happiness, understanding and mutual respect, along with the permanence of affection, housing, harmony and stability in accordance with the systems and purposes of Islamic law. The research also touched on the aspect of the mutual rights between the spouses within the family through research in the Islamic texts and jurisprudence of jurists, in addition to consideration of some of the vices and fatwas of the Malikis’ in particular, along with explaining the importance of these rights and their role in the stability of the family and its success in all stages of engagement and to the marriage contract, and ending with the consummation of marriage. This with a focus on the issue of the waiting for the wife’s psychological and full preparation for the beginning of a happy married life consisting of affection, compassion, kindness, tenderness and honor in the best manifestation salient of Islamic honors and views. From this point of view, the research tried to read some of the family's contemporary jurisprudential rules in the Malikis according to the theory of truth and its legal pillars. Which reveals the centrality of Islamic jurisprudence and its vital role through what the Maliki doctrine contains in the treatment of many of the developments known to societies, both old and new. This confirms the importance of the origins and sources on which the doctrine is based in the consideration of family issues and social relations. Moreover, that it is surrounded by many aspects of human rights in a variety of subjects. In this direction, the approach of the study and research is derived from one of the most important books of the Maliki doctrine, namely the book «Statement and Collection» of Ibn Rushd (grandfather), and its dealings with what is new in the theory of truth. Which is a point of purpose based on comparison, that confirms the abundance of Maliki jurisprudence and the development of their legal jurisprudence, in which it provides family and social relations solutions that may greatly help judges and muftis of our time to derive lessons, conclusions and benefits from them.
