|a تتمثل الأهداف الأساسية لهذه الدراسة في بيان الأصول والقواعد الفقهية التي تستند إليها مبادئ صلاحية الشريعة لكافة الأزمان وإصلاحها لحال البشر في كافة الأحوال، من خلال التركيز على مناهج التقعيد ووضع الضوابط والأسس التي تقوم عليها مسائل الاجتهاد، الذي يحقق المصالح ويدفع المفاسد وفق الميزان الشرعي لا وفق الأهواء والشهوات.\nاعتمدت الدراسة على أسباب اختيار الموضوع، وفي مقدمتها أن حفظ نظام الاجتماع البشري تتفق تماماً مع مقاصد الشريعة الداعية للصلاح والإصلاح، وذلك من خلال إثارة سؤال رئيس هو: كيفية الموازنة بين مبدئي الثبات والمرونة؟.\nوأما المنهج المستخدم في هذه الدراسة فهو المنهج الاستقرائي عن طريق تتبع جزئيات -الفروع -وصولاً إلى كليات (الأصول)، إلى جانب المنهج التحليلي والمنهج المقارن.\nوقد توصلت الدراسة إلى نتائج منطقية أهمها أن البناء الجيد للمجتمع المسلم يرتكز على الالتزام بما ينبغي أن يبقى ويخلد من أصول وكليات وقيم دينية خلقية، مع عدم إهمال المرونة في ما ينبغي أن يتغير ويتطور كالوسائل والأساليب. واقترحت في نهايتها بعض التوصيات بناءً على النتائج منها: العودة الكاملة للإسلام كمنهج حياة وتقديم الأنموذج الأمثل في دول عالمنا الإسلامي المتميز بقيم خلقية راقية.\n

|f The main objectives of this study are to explain the principles (usul) and jurisprudential axioms (qawaid) on which the principles of Sharia validity are based for all times and its benefit for the condition of human beings in all situations, by focusing on the methods of taqlid (imitation) and setting the controls and foundations upon which the issues of ijtihad (extrapolation) are based, which achieves the interests (maslaha) and staves off corruption according to the Islamic Legal (Shari) balance and not according to whims and desires.\nThe study relied on the reasons for choosing the topic, foremost of which is that preserving the human social system is fully consistent with the purposes of Sharia (Maqasid As-Shariah) that calls for righteousness and reform, by raising a major question: How to balance the principles of stability and flexibility?\nAs for the method used in this study, it is the inductive method by tracing the details of the branches to the faculties of (Al Usul (the Fundamentals)), in addition to the analytical method and the comparative method.\nThe study reached logical conclusions, the most important of which is that the good building of the Muslim community is based on a commitment to what should remain and perpetuate the Foundations (Usul), faculties, and moral values of religion, while not neglecting flexibility in what should change and develop as means and methods. And at the end of it, the researcher suggested some recommendations based on the results, including: the complete return to Islam as a way of life and the presentation of the ideal model in the countries of our Islamic world, which is distinguished by high moral values.\nThis abstract translated by Dar AlMandumah Inc. 2021
