المستخلص: يسلط هذا البحث الضوء على الخصائص المقاصدية للسنة النبوية؛ وأبرزها تلك العلاقة التأثيرية والتأثرية بين السنة ومنظومة التشريع، فالسنة من جهة ركن هام وفاعل في تأسيس المنظومة بالبيان والتفسير والتعليل وإعطاء النماذج التنزيلية، ومن جهة أخرى هي عضو متأثر بالنسقية الكلية للتشريع، المستخلصة من مجموع المصادر: (النقل والعقل والفطرة والخبرة الحسنة والأعراف المحكمة....)، ما يجعل السنة متأطرة بذلك المجموع في موضوعاتها، ومقاصدها، وفي منهج التنزيل في مختلف الفضاءات، تأطرا حتميا. فنشير من جهة إلى فاعلية السنة وتأثيرها في تشكيل منظومة التشريع، من جهة كون الخطاب النبوي خطابا مفسرا، مقصدا، كليا مجردا عن التشخصات الواقعية أحيانا قليلة، وأشير من جهة أخرى إلى مفعولية السنة في تأثرها بمنظومة التشريع حينما استنزلت الأحكام استنزالا نموذجيا على واقع رعيت فيه الأنساق والمناطات العامة والخاصة أحيانا كثيرة، وهما مقامان متباينان يتجلى من التفريق بينهما منهج الفهم المقاصدي للسنة النبوية، ومنهج التنزيل المقاصدي لنصوصها مهما اختلف الواقع وتغير. كما استهدفت الورقة التمييز بين فضاءات التنزيل، فالإيمانيات والغيبيات، غير التعبديات والسلوكيات، وهاتان غير الاجتماعيات الناظمة لأبعاد التمدن البشري، اجتماعيا، واقتصاديا، وسياسيا، وجماليا، وغير ذلك، فوجب ألا تحكم هذه الفضاءات المختلفة قاعدة تنزيلية واحدة، الأمر الذي يجلي مقاصدية السنة بشكل أكبر.

This research sheds light on the legitimate purposes of the Prophet’s Sunnah, and particularly that relationship of influence between the Sunnah and the legislation system. Indeed, the Sunnah is, on the one hand, an effective corner stone in building the system with statement, reason and interpretation and giving the revelated forms, on the other hand it is a member affected by the overall levels of legislation extracted from the different sources (citation, reason, instinct, experience and well-established customs) which decisively frame the Sunnah in its subjects and purposes and in the process of revelation in different fields. We discuss, on the one hand, the effectiveness of the Sunnah and its influence in building the legislative system, on the other hand, the prophetic rhetoric being an explanatory discourse, comprehensive and sometimes deprived from any realistic differentials. Besides, I highlight the effectiveness of the Sunnah as it is influenced by the legislation system when it established its typical judgements on a reality in which very often inconsistencies and the roles of public and private policies are taken into consideration. And they are two distinct concepts from which the method of the intentional perception of the Prophetic Sunnah is reflected and the intenti1onal revelation of its text regardless to the different and changing realities. Moreover, this paper intends to distinguish between sources of revelation as the matters of faith and the divine secrets are different from matters of worship and behavior and these are different from the socialization that is organizing proportions of human civilization, socially, economically, politically and aesthetically and so forth. Therefore, it is necessary that these different sources do not take as reference one revelation rule, which greatly puts on the spotlight the purposes of the Sunnah.
