المستخلص: الفهم المقاصدي هو المنهج الذي يضبط عملية الاستدلال بالنص الشرعي من حيث الفهم والتطبيق في ضوء الملاءمة بين ظروف النازلة التي يتناولها النص، والمقصد الذي يستشرفه من خلال تطبيقه. والفهم المقاصدي وإن كان منهجا في الاجتهاد فإنه ليس على عمومه وإطلاقه، بل هو منضبط ومقيّد بعموم الأدلة والقواعد والضوابط الشرعية، وبسائر الأبعاد العقدية والأخلاقية والعقلية المعتبرة، كي لا يتحول إلى ذريعة يُتوصل بها إلى تاريخية النص الشرعي وإلغائه أو تمييعه.والناظر في تراث الفقهاء يلحظ مدى اعتمادهم على الفهم المقاصدي في اجتهادات -على تفاوت بينهم -حيث يظهر ذلك جليا في آرائهم الفقهية. ولعلّ أبرز من سلك هذا المسلك، الإمام مالك رحمه الله، حيث كشف منهجه في الاجتهاد عن مدى اعتماده على الفهم المقاصدي في فهم السنة من خلال مجموعة من الضوابط والمسالك.

The understanding of the purposes (Makasid) is the method that controls the process of reasoning in the islamic text, in terms of understanding and application in light of the compatibility between the circumstances of the incident covered by the text, and the destination that it envisages through its application. And understanding of the purposes, although it is a method in ijtihad, it is not general and absolute. Rather, it is disciplined and restricted by the general nature of the evidence, rules and islamic controls, and all the significant ideological, moral and mental dimensions. So that it does not turn into an excuse to reach the historiography of the islamic text and to cancel it or to dilute it. A reviewer of the heritage of the jurists noticed the extent of their reliance on the understanding of the purposes for their jurisprudence, on the disparity between them, as this is evident in their jurisprudential opinions. Perhaps the most prominent person who pursued this path is Imam Malik, may God have mercy on him, as his approach to ijtihad revealed the extent of his reliance on intentional understanding through a set of controls and routes.
