المستخلص: يعتبر مبحث التعارض من المباحث المهمة والدقيقة في علم أصول الفقه، لأنه يروم درء التعارض الظاهري عن النصوص الشرعية، ومما يستعان به في تحقيق هذا الغرض: مقاصد الشريعة الإسلامية بضوابطها المرعية، لأنها تساعد على فهم نصوص الوحي، وتحديد المعنى المقصود منها، وذلك بفضل ربط النصوص والأحكام بمقاصدها وفهم الجزئيات في ضوء كلياتها. وفهم الحديث بمعزل عن المقاصد الشرعية يؤدي إلى الخطأ في معرفة مراد الشارع، لذا وجدنا العلماء على مر العصور يستحضرون مقاصد الشريعة في فهم الحديث النبوي، ويستنجدون بها في درء التعارض عن نصوصها، وقد جاء هذا البحث ليكشف عن هذا الجانب عند الإمام ابن دقيق العيد. وقد تناولت فيه مفهوم المقاصد، وضوابط إعمالها عند ابن دقيق العيد، ثم تحدثت عن أثر المقاصد في فقه الحديث عند هذا العلم من جانبين. الأول: أثر المقاصد في درء التعارض الظاهري عن الأحاديث من خلال مسلكي الجمع والترجيح. والثاني: أثر المقاصد في دفع التعارض عند تزاحم المصالح والمفاسد.

The study of the contradiction is considered one of the most important and accurate topic in the science of Usul al-fiqh, because it aims to ward off the apparent contradiction to poetic texts, and what is insignificant in achieving this purpose : the objectives of Islamic Sharia and its established controls, because it helps to understand the texts of revelation and determine the meaning intended, thanks to the fact of linking texts and their judgments with their purposes and understanding of molecules in the light of their words and understanding the Hadith in an isolation from the legal objectives leads to an error in knowing what the legislator really meant , so we found scholars throughout the ages recalling the purposes of the Sharia in understanding the prophetic Hadith and seeking their help in preventing the contradiction in its texts, and this research has come to reveal this aspect of Imam Ibn Daqiq Al-Eid.. In this research paper I have dealt with the concept of objectives (maqasid), and the standards for their implementation according to Ibn Daqiq al-Eid, then I talked about the effect of the objectives of Sharia on the jurisprudence of the Hadith according to this scholar from two aspects. First: The effect of the objectives (maqasid) in preventing apparent contradiction in Hadiths through the methods of combination and weighting. The second: the effect of the objectives in defending the conflict when interests and evils compete.
