المستخلص: لقد تشوف العقل الأصولي والفقهي منذ بدء تشكله إلى فهم مقاصد الشارع، وإذا كان التدوين قد اتجه أساسا إلى وضع القواعد، فهل يمكن اليوم الحديث عن فهم مقاصدي للسنة التشريعية، خارج المعرفة التي أسسها الفقهاء أصلا من أجل ضبط هذا الفهم؟ واليوم لا تكاد تخرج دعاوى الفهم المقاصدي للسنة عن اتجاهين: الأول: يتغيا تتبع هذا الفهم منذ تشكل في عصر الصحابة واستمر عبر تاريخ التدوين، وقد تجلى في مختلف علوم الشريعة، والثاني: اتجاه يتغيا التفلت من المنظومة الفقهية والأصولية بدعوى الفهم الجديد، فهل يمكن للباحث في نصوص السنة اليوم أن يكشف لنا عن مقاصد جديدة لا زالت كامنة فيما صدر عنه صل الله عليه وسلم قبل قرون؟

Since the beginning of its formation, the jurisprudential and fundamentalist intellect has looked forward to understand the objectives of the legislator, and if the codification has mainly tended to lay down the rules, is it possible today to talk about understanding the objectives of the legislative Sunnah, out of the knowledge that the jurists originally established in order to control this understanding? Today, the claims of understanding Sunnah based on its objectives hardly depart from two trends: the first one: seeks to trace this understanding since it was formed in the era of the companions and has continued throughout the history of the codification, and has been manifested in various sciences of sharia, and the second one: a trend that seeks to escape from the jurisprudential and fundamentalist system under the pretext of a new understanding, so Is it possible for the researcher in the texts of Sunnah today, to reveal to us new objectives that are still latent in what he, peace and blessings of God be upon him, issued centuries ago?
