تناولت الدراسة تدابير الحماية التقنية لحماية حق المؤلف على شبكة الإنترنت وقد هدفت الدراسة إلى تسليط الضوء على تدابير الحماية التقنية لحماية حق المؤلف على شبكة الإنترنت وذلك من خلال الأهداف الفرعية التالية: معرفة إمكانية الاستفادة من الشبكة الدولية للمعلومات في زيادة التوعية بحقوق الملكية الفكرية لحماية حق المؤلف بالإضافة إلى التعرف على التشريعات والقوانيين المحلية والدولية للملكية الفكرية، واكتشاف أبرز التحديات التي تحد من المحافظة على حقوق الملكية الفكرية بالسودان وسن القوانين اللازمة لذلك، وكذلك التعرف على أنواع حقوق الملكية ومجالاتها والمدة القانونية لحق المؤلف وأصحاب الحقوق المجاورة فيما ينشر إلكترونيا، كما هدفت أيضا على التعرف على سبل المحافظة على حقوق المبدعين في ظل النشر الإلكتروني المتاح على شبكة الإنترنت أهمية الدراسة يعد هذا البحث من الدراسات المهمة بالسودان والتي تسلط الضوء على موضوع بالغ الأهمية هو التدابير التقنية لحماية حقوق المؤلفين المتبعة من جانب الجامعات لحماية الملكية الفكرية لأعضاء هيئة التدريس والباحثين، كما أنها تمهد الطريق للدراسات المستقبلية في الاتجاه التشريعي وسن القوانين التي تكفل الحماية القانونية للمصنفات الرقمية للمؤلفين عبر شبكة الإنترنت بشكل علمي ومنهجي منظم. استخدمت في الدراسة المنهج الوثائقي وفقاً لأدبيات البحث عن الجانب النظري للدراسة وكذلك المنهج الوصفي التحليلي ووظفت فيه لجمع المعلومات وسائل المقابلة والملاحظة كما استخدمت في الدراسة الأدوات التالية: المصادر والمراجع الأوراق العلمية والبحث في الشبكة العنكبوتية. توصلت الدراسة إلى عدد من النتائج أهمها غياب التوعية لدى معظم مستخدمي الإنترنت بأهمية المحافظة على حقوق الملكية الفكرية والحقوق المجاورة للمنشورات الإلكترونية، كما توصلت الى أنه توجد تشريعات واضحة للحفاظ على حقوق الملكية الفكرية، إلا أنه لا توجد رقابة على تطبيقها. كما توصلت إلى أن المؤسسات الأكاديمية لم تضع التدابير الواضحة للحماية القانونية للناشرين عبر الشبكة للباحثين والمؤلفين لحماية منشوراتهم الإلكترونية وقد خرجت الدراسة بعدد من التوصيات أهمها: إيجاد أنظمة عربية موحدة تتبنى وضع تدابير تقنية تمنع وتجرم التحايل وانتهاك الحقوق لحماية حقوق المؤلف والحقوق المجاورة في البيئة الرقمية للمنشورات الإلكترونية عبر الشبكة. كما توصلت إلى ضرورة تبني وتشجيع إنشاء جمعيات عربية إقليمية ووطنية لإدارة حقوق المؤلفين والحقوق المجاورة في البيئة الرقمية ووضع قواعد وأنظمة لهذه الجمعيات. مع وضع تدابير الحماية التقنية اللازمة لحماية حقوق المؤلفين وبالتالي حماية المنشورات الإلكترونية وذلك للحد من التعدي على حقوق الملكية الفكرية للمؤلفين عبر الشبكة. حدود الدراسة الحدود الزمنية: خلال الفترة من يناير- ديسمبر 2019م.

The study used the documentary method, according to the literature of research on the theoretical side of the study, as well as the descriptive analytical method, and employed in it to collect information, interview and observation methods. The study reached a number of results, the most important of which is the lack of awareness among most Internet users of the importance of preserving intellectual property rights and the rights adjacent to electronic publications. It also concluded that there are clear legislation to preserve intellectual property rights, but there is no control over their application. It also concluded that academic institutions did not put in place clear measures for the legal protection of online publishers for researchers and authors to protect their electronic publications. It also concluded the need to adopt and encourage the establishment of Arab regional and national associations to manage the rights of authors and related rights in the digital environment and to set rules and regulations for these associations.
